With the rise of capitalism and the development of the industrial revolution,the handling of labor disputes has become more and more a worldwide problem,will directly affect a country or regional labor relations and the stability of social conflict ease.In recent years,the construction of the Guangdong-Hong Kong-Macao Bay area has been advancing rapidly,and the political,economic,scientific and technological,cultural and other aspects in the region have been developing rapidly.The flow and integration of outstanding talents in Guangdong,Hong Kong and Macao has gradually become a normal development,the number of labor dispute cases involving Hong Kong and Macao workers and enterprises has been increasing year by year.For reasons such as “ the One Country,Two Systems,the three regions,the two legal systems,and the three legal systems“,there are many differences among the existing labor dispute settlement mechanisms in Guangdong,Hong Kong and Macao in terms of the overall design,the connecting relationship between the organizational structure and the specific mechanism,etc.in the practical operation of handling Labor disputes involving Hong Kong and Macao,a series of problems have arisen,such as difficulties in obtaining the legal documents of labor disputes,in cross-regional investigation,in hearing and hearing cases,in implementing them,and in choosing and applying laws,in exchanging and sharing information,and in communication and coordination.How to avoid friction,complement each other’s advantages and win-win cooperation,and solve the difficulties in handling labour disputes involving Hong Kong and Macao in the Grand-Baie Bay area has become an important issue that has to be faced and urgently resolved in the construction of a first-class Bay area.On the basis of clarifying the relevant concepts such as labor dispute and its settlement mechanism,this paper puts forward that the settlement of labor disputes involving Hong Kong and Macao in the Grand-Baie district faces difficulties,the innovation of three factors,which must be focused on: the concrete mechanism of the handling mechanism,the mode of linking up the organization and the concrete mechanism,is supported by the theory of “One Country,Two Systems“,the theory of Regional Public Management and the theory of synergetic governance,based on the current situation of the development of the Guangdong-Hong Kong-Macao Bay area,the different labor dispute settlement mechanisms in the three places and the fact that the number of labor dispute cases remains high,this paper expounds the four problems existing in the difficult situation,such as the legal obstacles in Guangdong,Hong Kong and Macao,the low efficiency of the domestic processing mechanism,the difficulties in connecting the organization and the lack of judicial cooperation agreements,etc.It also analyzes the reasons from four aspects: the different legal sources and legal systems,the different design and function of Labor Dispute Settlement Mechanism,the different organization structure and the different connection mode of mechanism.In order to break through the difficulties in dealing with Labour disputes involving Hong Kong and Macao in Grand-Baie,the author suggests that,on the premise of adhering to the“One Country,Two Systems“principle,the time point for the reunification of Hong Kong and Macao should be determined,three steps will be taken to explore and innovate the mechanism for handling Labour disputes involving Hong Kong and Macao in the Grand-Baie Bay area.At this stage,the first step is to establish a mechanism for handling labour disputes involving Hong Kong and Macao in the nine cities of the mainland of the Guangdong-Hong Kong-Macao Bay area,and specifically put forward the top-level design of the legislative mandate,specific mechanisms designed to seek common ground while reserving differences,close to the unity of organizations and institutions and the integration of the relationship between the model of innovation and other four countermeasures,the second and third steps will gradually carry out targeted exploration based on the practice of the first step,with a view to playing a Tossing out a brick to get a jade gem role in the construction of harmonious labor relations in the Guangdong-Hong Kong-Macao Bay area by government departments.
