Study On The Legislation Improvement Of Urban Domestic Waste Classification In China

At present,my country’s natural resources are facing a severe situation,and some natural resources are even gradually depleted.In the past ten years,in order to protect natural resources,China has adopted export tariffs,export quotas,export licenses and other measures to restrict the export of natural resources,which caused dissatisfaction in developed countries and filed lawsuits in China.Losing the "China Raw Materials Case" and "China Rare Earth Case" means that China cannot impose restrictions on natural resources.At the same time,it also means that it must provide natural resources to foreign importing countries without any obstacles.In order to protect China’s scarce natural resources for a long time,it is necessary to formulate sound and reasonable regulations that comply with international rules and can regulate the export volume and volume.The export mechanism of natural resources based on price requires various efforts to finally realize the purpose of protecting resources and the environment.my country has also achieved certain results in the comprehensive protection of natural resources and the ecological environment.my country’s first "Green Tax Law",the "Environmental Protection Tax Law" has been implemented since January 1,2018,with the purpose of strengthening the corporate responsibility for green environmental protection.my country implemented the "Export Control Law" on December 1,2020.This is my country’s first law in the field of export control and fills the gap in China’s export laws for strategic commodities.The content of the “Export Control Law” is mainly to protect China’s national security by controlling the export of sensitive materials and technologies on the list.Compared with other countries,my country has a large amount of rare earth reserves.According to the data of the General Administration of Customs,the year of 2020 In October,my country exported 28,700 tons of rare earths overseas,a decrease of 28.4% from the same period last year.On the whole,my country currently plays a certain role in the export control of natural resources,but from laws to administrative regulations and rules,and then to local legislation,the provisions on natural resources are too general and not perfect and specific.Therefore,the author focuses on the discussion and research on the legal problems existing in the export control of natural resources in our country and the improvement of the export control system.The introduction of this article includes the topic background and research significance,as well as the current situation,research ideas and methods of domestic and foreign research on natural resource export control.The first part of the main text is the concept and measures of my country’s natural resource export control,the necessity and China’s commitment to the restriction of natural resource export by joining the World Trade Organization.The third part is to point out the problems existing in my country’s current natural resource export control system.The fourth part introduces the natural resource export control legislation of developed countries and its enlightenment.The author mainly selects the legislation of the United States,the European Union and Japan,and introduces the advantages of these countries’ natural resource export control systems.The fifth part is to improve China’s natural resource export control system based on the current problems and the useful experience drawn from the legal systems of developed countries,combined with China’s national conditions.
