On The Improvement Of China Export Control Legal System

Export control is the behavioral management and control of export-controlled items through the formulation of laws and the issuance of government orders.Export control can not only reflect a country’s political trends,but can also reflect issues such as nuclear safety,military and economic development,and the protection of the environment and natural resources.Export control is an important means for countries in the world to ensure national security,combat terrorism and control turmoil,prevent the proliferation of nuclear weapons,and protect scarce natural resources.At present,there are many uncertain risks in the world.Violent attacks by international organizations often occur.If countries do not specify export control laws,they will not control weapons of mass destruction and their means of delivery,conventional weapons,and related dual-use goods and technologies.If it is allowed to spread,international peace and world security will not be guaranteed,and the people will live in a fiery environment.Therefore,it is necessary to implement export control policies.In addition to fulfilling the export control obligations entrusted by international treaties,China must also actively improve its own export-related laws and regulations,and contribute its own strength to the development of world export control.Therefore,China promulgated and began to implement the "Export Control Law" at the end of 2020.This law has five chapters and 49 articles,focusing on the management,supervision and management of military products and dual-use items,as well as administrative and criminal liabilities for violations of export controls.This paper studies the international treaties and agreements of multilateral mechanisms for export control,as well as the export control policy and legal system of the United States and the European Union,combined with the current situation of my country’s export control legal system,analyzes the problems,explores the practices of the United States and the European Union,and finds out what my country can learn from,And finally come up with suggestions to improve my country’s export control legal system,enrich the legislative content of export control,and establish and improve related supporting facilities.This article is divided into four sections.The first section focuses on the legal basis for export control,and analyzes the economic and political objectives of its establishment,as well as describing the international treaties and multilateral mechanisms for export control,including the development and establishment of the main multilateral mechanisms,International treaty rules,WTO measures,etc.The second panel explains the emergence and development of my country’s export control system,introduces the specific system of my country’s export control,and deeply analyzes the current problems in my country’s export control legislation and operation.The third panel compares the export control institutions,the specific provisions of the export control system,etc.,as well as the status of the reform of the United States and the European Union’s export control systems.Finally,aiming at the current problems in my country’s export control legislation and operation proposed above,we will improve our country’s export control system.
