| As a new way of governance,punishment for dishonesty has a very obvious effect on punishment for dishonesty behavior.And,Through the analysis of theoretical principles such as the theory of rights protection,the principle of equal protection,the principle of proportionality,the principle of legal reservation and the principle of due process.This article adopts the literature research method and case study method,from the perspective of rights protection,taking the untrustworthy subjects as the research object.This article removes the introduction and conclusion.There are three chapters to study the issue of rights protection in the punishment of dishonesty.The first chapter is mainly an overview of the rights protection of the punishment system for dishonesty.Through the definition of relevant concepts such as dishonesty and punishment in the punishment system for dishonesty,it is clear that the main research of this article is a kind of punishment for dishonesty carried out by the public authority of the state.Point out that in the process of punishment of dishonesty,the public authority of the state,it is necessary to protect the personal dignity,property rights and some procedural rights of untrustworthy subjects.The second chapter is mainly about the lack of protection of the rights of untrustworthy subjects in the practice process of the punishment system for dishonesty and its causes.Mainly expounds the state public power organs in the process of practice.Because of the lack of legislation in the punishment system for dishonesty,lack of effective supervision and guarantee mechanism.As well as the imperfect relief procedures for the protection of the rights of untrustworthy subjects,etc.The lack of protection of legal rights such as reputation rights,privacy rights,property rights,and some procedural rights of untrustworthy subjects.The third chapter mainly aims at the analysis of the reasons for the lack of protection of the rights of untrustworthy subjects in the system of punishment for dishonesty and puts forward corresponding suggestions for improvement. |
