Research On The Protection Of The Rights Of Dishonest Persons Subject To Enforcement

Since the implementation of the list of untrustworthy persons subject to enforcement in my country in 2013,untrustworthy persons subject to enforcement under the title of "Lao Lai" have become targets of "verbal criticism" from all walks of life.However,the disciplinary mechanism for dishonesty,which is led by the public power of the state,has gradually exposed its shortcomings in the protection of the rights of the person who is dishonestly enforced.Due to the lack of legal basis for punishment of dishonesty,irregular disciplinary measures,and imperfect right relief measures for dishonest victims,the personal rights,property rights and some procedural rights of dishonest executioners have been damaged to varying degrees.The protection of the legal rights of the person who is untrustworthy should be regarded as an indispensable part of the punishment mechanism for dishonesty.The article starts from the legislative and judicial levels,combined with the current development situation in my country,and proposes that the implementation concept of punishment for dishonesty and incentives for trustworthiness should be established.In terms of specific system construction,the content and method of disclosing information should be clarified,and the procedures should be improved.Safeguard measures,relying on technical means such as "smart courts" to protect the legal rights of untrustworthy persons subject to enforcement can only return to the original intention of the establishment of the system.
