Legal Research On Incentive Mechanism Of Cleaner Production

The implementation of cleaner production is an important way to realize the sustainable development strategy of our country,and also an important guarantee to build a resource-saving and environment-friendly society.At present,incentive mechanism is more and more used in the legislation of environmental resources law.On June 29,2002,China promulgated the Cleaner Production Promotion Law(revised in 2012).As a kind of promotion legislation,the law weakens the compulsion of the law,takes the incentive norms as the main content,and highlights the encouraging and guiding characteristics of the law.This law has played an important role in swearing and guiding the development of cleaner production in China,but at the same time,there are some problems such as too much principle and lack of operability,which leads to a great discount in the incentive and promotion of cleaner production.Due to the lack of effective incentives,enterprises lack of endogenous power to implement cleaner production.Therefore,it is necessary to improve the existing incentive mechanism of cleaner production in China.By strengthening the role of incentive mechanism,promote the smooth progress of clean production in China.This paper discusses the incentive mechanism of cleaner production in five parts:The first part is the concept and theoretical basis of the incentive mechanism of cleaner production.Firstly,the concept of incentive mechanism related to cleaner production is defined,including the concept of cleaner production,the concept of incentive,the concept of incentive factors and the concept of legal incentive mechanism;secondly,the function and characteristics of incentive mechanism are discussed;thirdly,the types of incentive mechanism of cleaner production are introduced;finally,the theoretical basis of incentive mechanism of cleaner production is introduced.The second part is the analysis of the incentive mechanism of cleaner production in China.First of all,it discusses the necessity of implementing the incentive mechanism of cleaner production,and concludes that the incentive mechanism of cleaner production is very important for the sustainable development of our country from four aspects;secondly,it discusses the existing incentive mechanism in China.The third part is to analyze the existing problems of cleaner production incentive mechanism in China,pointing out the existing problems of cleaner production incentive mechanism from four aspects.The fifth part is to improve the incentive mechanism of cleaner production in our country.It puts forward suggestions from four aspects: enhancing the operability of theincentive mechanism,improving the economic incentive measures,improving the non economic incentive measures and enhancing the Actionability of the incentive mechanism.
