In order to effectively reduce the harm brought about by drugs,the state has been increasing its efforts to crack down on drug trafficking and drug abuse,and has adopted different methods and means to help drug addicts get rid of drug addiction effectively.Combined with the analysis of the relevant rules and regulations and requirements of the drug control law,it is not difficult to find that compulsory isolation,community detoxification,voluntary detoxification and community rehabilitation are the main and effective measures in China.Judicial administrative organs and public security organs should gradually strengthen contact and cooperation,implement administrative compulsory measures of compulsory isolation and rehabilitation,and help drug addicts get rid of drug addiction effectively.However,there are many problems and contradictions in the specific implementation,such as the decision and change of compulsory isolation drug treatment are not in accordance with the law,and are usually accompanied by subjective factors such as random and anomie;the decision-making organ’s examination and approval is not standardized or slow when the executive organ reports to terminate the drug addiction treatment in advance or postponed;the public security compulsory isolation drug rehabilitation center and the judicial administration compulsory drug rehabilitation center belong to different departments,and the law enforcement standards are different The management system of the compulsory isolation drug rehabilitation center follows the reeducation through labor system;the contradictions and constraints found in the judicial practice of relevant laws and regulations reflect the defects and lag of the law itself;the implementation of the compulsory isolation drug rehabilitation system has a short history and lacks professional drug rehabilitation mode and talents,etc.,which threaten the rights and interests of the compulsory isolation drug rehabilitation personnel and affect the judicial credibility.Research on the protection of rights and interests of drug addicts in compulsory isolation is not only the need of the times in a society ruled by law,but also can fully reflect human rights,further promote national development,truly build a harmonious society,and realize the construction of fairness,public welfare and fairness of laws and regulations.After sorting out the related contents of the rights and interests protection of drug addicts in compulsory isolation,this paper studies the progress of human rights and the reform achievements of the judicial administrative compulsory isolation drug rehabilitation places,finds out the problems in the process of judicial practice,and draws lessons from the experience of overseas drug addicts’ rights protection.On the premise that the system of compulsory isolation for drug treatment remains unchanged,this paper considers the ways to protect the rights and interests of drug addicts in compulsory isolation,and puts forward suggestions: amend the drug law,the organic law of the people’s Procuratorate and other relevant laws and regulations on drug treatment,improve the contradictions,constraints and deficiencies with the current work,clarify the law enforcement supervision,and unblock the relief channels;from the assessment,system,working system,and enforcement measures,we should improve the relevant laws and regulations The law team and other aspects should improve the relevant system of drug treatment.In order to build a harmonious society,China also needs to build a sound social security system,advocate equality,eliminate discrimination,and enable drug addicts to obtain vocational skills training and survival ability,so as to successfully quit drug addiction and establish a foothold in society.
