An Exploration Of Debt Legislation In The Shaanxi-Gansu-Ningxia Border Region

The history of the legal system in the revolutionary base areas is a monument on the road of legal construction of the CPC,which contains a large number of valuable experiences worthy of serious exploration.In the Shaanxi-Gansu-Ningxia border area,the Party and the people’s power under its leadership have gradually matured in their exploration of revolution and construction,and the level of their legal system construction is at the forefront among the base areas,which is a good model for studying the rule of law activities of the people’s power before the founding of New China.The current study of the legal system construction in the New Democracy period has been fully explored,but it still focuses on the macro grasp,and not much research has been done on the sectoral laws,such as the civil legislation field,especially the debt law field.The reason:on the one hand,with the level of economic development at that time,the types of debt were relatively simple,mostly concentrated in the field of private lending,and the development of debt law was not fully based on today’s society;on the other hand,limited by the level of legislation at that time,the content of debt law was mostly mixed with other legal norms,often covered by other studies,and only half of its scales could be seen.However,the treatment of debts is an important issue that needs to be studied at the level of policies and laws since the CPC created the rural revolutionary base,and it is necessary to discuss and analyze the topic.The construction of the debt law in the Shaanxi-Gansu-Ningxia border area reflects the people’s power’s adjustment of civil lending relations,which has profound political and legal significance.Therefore,this paper will systematically summarize and analyze the debt law of the border area from the perspectives of sociology and jurisprudence,starting from specific decrees and relevant historical materials,and attempt to clarify and theorize the construction of the debt law of the border area.By systematically organizing and crawling through party and government documents and various historical materials in the border areas,our research can reveal that the border area debt laws can be roughly divided into three stages,covering old debts,new debts,and usury.Throughout the changes of these legislations,there are two main lines running through them:one is to defend the achievements of the land revolution and serve the new democratic revolution;the other is to accelerate the economic construction in the border areas and promote the development of the new democratic society.At different stages,due to the changing situation in the border areas,the focus of these two elements varied,but all of them carried out the concept of "the mountains are the people,and the people are the mountains".The law reflects the exploratory process of the CPC in coping with its changing role at a time of great social changes,and the legislative logic behind it has also witnessed the glorious years of the CPC from infancy to maturity,and the basic principles and ideas contained therein have useful inspiration and lessons for today’s society.
