With the rapid development of science and technology,artificial intelligence is changing the social life of human beings.The discussion of artificial intelligence has also brought many legal problems.From the discussion of the existing tort law,intellectual property law,product liability law and other fields,all relevant legal problems can be traced back to a source problem,that is,artificial intelligence Whether intelligence has legal subject status.Under the background that artificial intelligence will take on more social roles,our law needs to give an answer and solution to this original problem,so as to make the society run better.According to the natural division of its attributes,legal subjects are manifested in two aspects,Natural persons and legal persons.Considering that the concept of independent corporate identity also originated from the concept of natural persons,this thesis will focus on the evaluation of different theories of legal subject status of artificial intelligence and draw feasible solutions.This article is divided into four chapters.The first chapter is the meaning and definition of the concept of legal subject status.Chapter 2points out the evidence of the legal subject status of artificial intelligence,and on this basis,it extends the discussion of the legal subject status of artificial intelligence.The third chapter classifies the legal subject status of artificial intelligence,analyzes and summarizes the two opinions of opposing and supporting the legal personality of artificial intelligence,and draws the conclusion that the legal subject status of strong artificial intelligence should be given.The fourth chapter,based on legal fiction,discusses the theoretical construction and practical exploration of strong artificial intelligence as the legal subject status.
