The Study Of The Legal Status Of Artificial Intelligence

With the progress of network technology and information science,the research on artificial intelligence(AI)has developed rapidly.AI has also entered into the daily social life of people,they have brought a lot of conveniences to human’s production and life.However,as AI is being used more widely,there are many legal issues caused by AI in practice.Clarifying the legal status of AI is the prerequisite for solving these problems.Subsequent theoretical researches and legal practices can proceed smoothly only after clearing the legal status of AI.The research content of this article is the legal status of AI,which mainly including the following four parts:The first chapter is a general overview of AI,it will introduce the definition,development and classification of AI,and it will limit the concept and scope of AI studied in this article at the same time.The second chapter will introduce briefly some legal problems caused by the ambiguity of AI’s legal status,and draw out the significance of studying the legal status of AI.At the same time,it will briefly review the current views of various AI’s legal status.The third chapter will clarify the criteria for determining the legal status of AI.It will analyze the concepts of legal subject and legal object in legal status.By studying the subject and object in philosophy and law,it will clarify the standards for identifying legal subjects and legal objects.It will determine that the legal subjects need to meet the biological factor,rational factor,ability factor,and social factor,and the legal objects need to satisfy the entity factor and value factor.The fourth chapter will discuss the legal status of weak AI and strong AI,it will find that the weak AI don’t get all the factors like biological factor,rational factor,ability factor,and social factor,the paper will deny the weak AI’s legal status as the legal subject,then it will find that the weak AI get all the factors like physical factor and value factor,the paper will confirm its legal status as the legal object.Then the paper will discuss the possibility of the strong AI being invented from policy and technology,and deny the strong AI’s legal status as the legal subject with a cautious attitude.
