The Main Manifestations,Causes And Corrections Of The Deviations In The Implementation Of The "Three-rights Separation" Policy In Agricultural Land

In 2013,the idea of "separation of the three rights" of agricultural land sprouted;In 2014,the No.1 Central Document profoundly elaborated on the policy content of the "Three Rights Separation" of agricultural land;In 2015,the 13 th Five-Year Plan put forward an overall strategic deployment for the "three-rights separation" of agricultural land;In 2018,the policy of "separation of powers of the three rights" of agricultural land was confirmed from the legal level.It can be seen that since the central government proposed the "three rights separation" of agricultural land,the policy has been gradually and deeply advanced,the policy performance has been greatly released,and the rural economic development has achieved great results.Especially at this stage,in the process of comprehensively promoting rural revitalization,the "three-rights separation" of agricultural land,as an important institutional supply and support,is of great significance to deepening rural reforms and realizing the goals of the "14th Five-Year Plan".However,as the policy of “separation of powers of the three rights” of agricultural land enters the critical stage,the effect of the policy is showing a diminishing effect,and there is an urgent need to pay attention to the problem of policy implementation deviation.In view of this,This paper adopts the research methods of literature analysis,theoretical analysis,questionnaire survey and interview method,and uses Matland’s "fuzzy-conflict" model to analyze the policy attributes and main manifestations of deviations in the implementation of the "three-rights separation" policy on agricultural land.Factors that determine the attributes of a policy.Then it analyzes the reasons for the deviation in the implementation of the "three-rights separation" policy for agricultural land,and proposes corresponding corrective measures.Specifically,it mainly selects concepts such as rural land and agricultural land "three-rights separation",policy implementation deviation,and related theoretical foundations such as modern property rights theory and policy implementation deviation "fuzzy-conflict" model.The policy attributes of the model are studied.Through analysis,it can be found that the implementation of the "three-rights separation" policy for agricultural land will deviate from the policy objectives and cause deviations.For example,the policy implementation deviation of the implementation of collective ownership is manifested as "symbolic execution + political execution".The policy implementation deviation of stabilizing the contracting rights of farmers is manifested as "administrative execution + political execution".The policy implementation deviation of deregulating land management rights is manifested as "political execution +experimental execution".The policy implementation deviation of the relationship between the "three powers" is manifested as "experimental implementation".Further in-depth analysis of the causes of deviations in the implementation of the "three-rights separation" policy for agricultural land,For example,the limited power and power at the grassroots level leads to deviations in the implementation of collective ownership policies;Lack of resources and rigid power lead to deviations in the implementation of the policy of stabilizing the contracting rights of farmers;Insufficient incentives and lack of flexibility in scenarios have led to deviations in the implementation of policies for deregulating land management rights;The rigidity of the scenario model has led to deviations in the policy implementation of the relationship between the "three powers".Based on these obstacles,the following corrective measures are proposed: Strengthen theoretical research and policy publicity,and increase policy participation and identity;Improve and improve the legal system,strengthen policy coordination,and break through institutional barriers;Increase the "sinking" of human,financial,material and other resources to solve the practical dilemma;Complete and perfect the coordinated supporting mechanism to give full play to the overall effect.
