With the development of technology,the support of the state and the influx of capital.The development of the electric competition industry is very rapid,and the scale and profit of the whole industry have increased year by year.In order to seize the market and profit,the copyright infringement cases of the live broadcast of the electric competition occur frequently.This article is divided into five parts.First of all,it introduces three judicial cases.By summarizing,we can draw the conclusion that the focus of the dispute over the live video game infringement lies in whether the live video game is a work in the sense of copyright law and whether the reasonable use of the infringer’s defense is justified.Based on this,this paper then gives an overview and analysis of the concept and related subjects of live video games,focusing on the legal attributes and ownership rights of live video games.Then,it introduces the infringement forms of the current live broadcast of electronic games,analyzes the viewpoint of"reasonable use",and points out that the live broadcast of electronic games damages the market of the owner and cannot constitute reasonable use.The following is the copyright infringement research of the live broadcast of the electronic competition.Based on the comprehensive cases and the existing laws and regulations,this paper proposes that the live broadcast of the electronic competition game does not infringe the rights of the owner to spread information on the network,broadcast,show and perform,but infringes other rights that the copyright owner should enjoy.And pointed out that the infringer should bear the corresponding tort liability.The last part of the article is mainly aimed at the shortage of copyright protection of live video games,and puts forward corresponding improvement suggestions.
