Abstract/Summary:
In recent years,with the fast development of Internet industry and the combination of network and information technology like cloud computing and big data,the era named“ Internet +” has already come,which attributes to the deep integration of Internet and various industries.By the new Internet technology,the game industry is in expansion.From the earliest single model to more and more electronic competitive game,and finally the derivation of live webcast of e-sports game which is in accordance with the way of the Internet thinks.The live online webcast of e-sports games is a hot topic in recent years.Due to the shortcomings of the legal type of copyright in China and the change of business model of E-sports game industry,the e-sports live online webcast has become a new problem in the field of copyright.Infringement disputes of the game live online is also worthy of our attention.In China’s current legal framework,the E-Sports game can only be included in the film works and film-like works.There should be a new type of work that is more suitable for electronic games to be written into the copyright law.The legal status of the game players also depends on the type of game design.In the e-sports online webcast,the game can be divided into two modes and the infringement of each mode is different.Therefore,to deal with the current dilemma of the legal protection of E-games industry,it is necessary to clarify the ownership of rights happens in the process of e-sports games live webcast.This paper focuses on the emerging field that is practice oriented.And through the analysis of the first domestic e-sports live webcast,it introduces the concept of e-sports live webcast and the present situation of the development of this industry,With the study of case that is whether pictures of E-sports live webcast are protected by the copyright law,which draws heated discussion in the academic and practice world.And then in this paper I put forward the analysis of game picture copyright.In the end,I reached a conclusion that pictures are works,and they should be protected by the copyright law.Then it discusses other copyright problems involved in the e-sports games live webcast,and analyzes the definition copyright infringement and its reasonable limit.In the end,by analyzing the difficulties of copyright protection in the field of e-sports games live webcast,I put forward suggestions of how to improve the current legislation.
