Research On The Interaction Between Network Public Opinion And Judicature

The relationship between public opinion and justice is an unavoidable content of the construction and development of the rule of law.At present,the Internet media has changed the way information is disseminated,which has profoundly affected human society.In the public domain,the traditional media is becoming more and more gradual,and public opinion has been separated from the guidance of traditional media and formed a new "network public opinion field".The internet public opinion caused by hot legal cases has profoundly affected the administration of justice.The interaction between network public opinion and justice is deepening.The author makes an empirical analysis of hot cases through the research perspective of communication science and law,understands the interaction between network public opinion and justice,and further discusses the deep reasons of the influence and restriction of justice of network public opinion,and finally puts forward the suggestion of regulating network public opinion,maintaining judicial authority,and realizing the benign interaction between network public opinion and justice.The interaction between network public opinion and judicial trial has a certain social basis,and the media’s supervision of the judiciary at that time,giving way to the interaction between the network public opinion and the judiciary,becomes more complicated in itself,and the participation of network public opinion in judicial activities is the proper intention of the society under the rule of law.The right of citizens to freedom of expression,which is embodied in the network public opinion itself,can be realized to the greatest extent through the network media.In the construction of social rule of law,the reconstruction of the public domain,the pursuit of judicial democratization of consultation democracy,and the need for the judicial initiative to participate in the interaction of network public opinion,which has also become the proper meaning of the construction of socialist rule of law in China.In reality,it is necessary to interpret how the network public opinion and justice interact.The author mainly uses the classical theory "5W" mode of communication to analyze the hot cases.Through the study of information communicators,information content,media,audience and acceptance effect in hot cases in recent years,we find that the change of network public opinion on the information dissemination of traditional cases.With the weakening of traditional media,its social monitoring capability is reduced,and the benign interaction between traditional media and justice is weakened.Chaotic network public opinion has become the dominant,network public opinion field,the media "gatekeeper" role in effect,the mainstream media and judicial authority derogation,the agenda set confusion,as well as hot cases frequently appear public opinion reversal.The cases of public opinion on the Internet have certain laws and have a certain influence on the judicial decision.And the judiciary can also from the case decision and norm-setting to the network public opinion response.Although the internet public opinion can promote the progress of justice,but more often on the judicial constraints,increase the burden of judicial activities themselves,but also violated the rights of relevant personnel.This phenomenon can be understood in three ways.First,the impact of online media content on society and justice.The commerciality of the media dominates the network media,and the traditional media and the network’s emerging self-media compete with each other in the network,pursue the speed of information dissemination and win the "traffic" in order to obtain the benefits.The objective and fair reporting principle of traditional media and the watchfulness of the social environment are killed by fierce industry competition.Network media reported hot cases,sometimes the use of tendentious words and false information,to create public opinion and judicial opposition,and then interfere with the judicial decision,infringe the rights and interests of the parties.Secondly,the network media technology aggravates the influence of public opinion on justice.Network media technology makes society experience the "inward explosion",the traditional era of decomposition and cutting,mechanical technology and specialized sub-...
