A Study On The Trial Of Discipline Inspection And Supervision Cases At The Grassroots Level

In the past 40 years since the restoration and reconstruction of the party’s discipline inspection organs,the grass-roots discipline inspection and supervision organs have played a barrier role in the vital interests of the examines and the implementation of discipline and the rule of law through the case trial process.With the deepening of the reform of the national supervision system,the Discipline Inspection Commission and the Supervision Commission jointly perform the two functions of discipline inspection and supervision,and the trial departments of discipline inspection and supervision cases at the grass-roots level have changed from the single trial of disciplinary cases in the past to the double trial of discipline and law.The trial of grass-roots cases is the "gateway" and "export" of the discipline inspection and supervision organs.It is responsible for the supervision,examination and investigation of the internal work and the development of disciplinary administrative sanctions.It is a window for the judicial organs to draw up prosecution opinions.The grass-roots discipline inspection and supervision cases have the characteristics of involving a wide range of supervision objects and complicated cases.The quality of their trial work is directly related to the effectiveness of deepening reform.The Third Plenary Session of the 19 th CPC Central Commission for Inspection working conference emphasized that the next work focus of discipline inspection and supervision organs is to help and promote discipline inspection and supervision organs at all levels to continuously improve the quality of cases,and to provide endogenous impetus for deepening the institutional advantages of supervision system reform and accelerating the transformation into anti-corruption weapons.Based on the investigation of the work before and after the reform,this paper systematically combs out the contents and relevant norms of the case trial of the discipline inspection and supervision departments in 10 districts and counties under the jurisdiction of G City,and points out that there are still many problems in the case trial of inspection andsupervision under the backdrop of the reform of the supervision system: first,the case diversion and personnel allocation are unreasonable,It leads to the serious situation that there are too many cases and too few people at the grass-roots level;the second is the poor connection between discipline and law,which leads to the inaccuracy of qualitative and quantitative punishment and the disorder of connection procedure;the third is the poor quality of the grass-roots discipline inspection and case handling personnel,which leads to the incompleteness of the content of the investigation and the lack of strict quality of the violation of discipline;the fourth is the deviation of personal concept,which leads to the formality of the trial norms.The main reasons for the above practical problems are as follows: 1.After the reform,the number of cases to be heard has doubled,the number of cases to be handled has increased sharply,the number of cases to be handled has decreased seriously,and the professional level of case handlers is not high;2.The deepening of the reform of the supervision system is in the stage of perfection,As a part of reform and refinement,case trial has not kept up with the standard of connection and the construction of talent team;3.The lack of top-level design in the system of "township case and county trial" is difficult to be implemented,and the absence of full-time case reviewers makes it difficult to eradicate the situation of no distinction between investigation and trial;4.Some contractors have the concept of focusing on violations of laws and disciplines rather than procedures,It leads to the situation that the nature of the violation of discipline is not strict,the procedure is not strict and the connection procedure is out of order,resulting in the indefinite trial of the case for a long time.Therefore,it is imperative to improve the system and mechanism of grass-roots case trial from the top to the bottom.First,we need to ensure that we start with adjusting the structure of the trial team,strengthen the allocation of full-time grass-roots case trial personnel,improve the ideological awareness and professional quality of the undertaker;second,we need to correct the ideological awareness from the source,Improve the political position and implement the leadership responsibility system;Finally,follow up and improvethe supporting process and audit norms of "township case and county audit",rationalize the trial mechanism and coordinate the internal and external connection procedures,so as to strictly control case quality as the goal of achieving the "last kilometer" of supervision over public officials with quality and quantity guaranteed.
