An Analysis Of The Disputes Over Land Rights And Interests Of The Married-off Women And Their Children

With the continuous advancement of urbanization in China the value of land rises,because of the disputes caused by the riots and interests of the land is also more and more.Due to the unclear legal provisions,the courts in different regions have different attitudes towards the disputes,and the results of the disputes are quite different.Among them,there is a big dispute on the land rights and interests of vulnerable groups such as married-off women and their children.In this paper,a typical case of how to deal with such vulnerable groups of and rights disputes on a simple discussion,I hope the ability to handle judicial cases to provide some reference.This paper is divided into three parts.In the first part,the author combs the typical cases,the judgment results of each court,sorts out the focus of disputes,and understands the current judicial status of the land rights and interests disputes of the married-off women and their children.The second part of this paper analyzes the focus of the case,and leads to the issue of land rights and interests protection of the married-off women and their children.Sorting out the main manifestations of the current infringement of the married-off women and their children,the married-off women and their children are treated differently in the compensation of land acquisition,the contracted land of the married-off women is occupied,and the right to use the homestead of the married-off women is infringed.This paper analyzes the reasons for the infringement of the land rights and interests of the married-off women and their children,mainly from the aspects of imperfect laws and regulations,unimpeded judicial relief channels,violation of village rules and regulations,and weak self-help ability.The third part of this paper is the legal thinking caused by the analysis of this case,and puts forward the principles that should be followed in dealing with the disputes of land rights and interests of the married-off women and their children,and then further puts forward specific solutions.
