Research On The Distribution System Of Compensation Fees For Land Acquisition Contracted By Rural Out-married Women

In recent years,with the acceleration of urbanization,the industrial demand for land has grown rapidly,and a large amount of agricultural arable land has been requisitioned by the government for non-agricultural construction.Therefore,the disputes about land in rural areas have increased greatly.The legal land rights and interests of rural out-married women have been infringed in different degrees in rural collective economic organizations.Among them,the main disputes are: first,whether rural out-married women can get the membership of their village group;Second,after the collective discussion of the villagers’ congress and the villagers’ meeting,they jointly worked out the plan about how to distribute the compensation for land expropriation of contracted land.Whether the rural out-married women can enjoy the same compensation expenses as other general villagers.However,with more and more cases of land expropriation and compensation cost allocation disputes being brought to court,some problems have emerged to be solved urgently.First of all,whether accept or not,the decisions made by the courts are different;Secondly,after the court accepts the case,courts in different regions have different opinions when dealing with similar cases,and the judgment results may be different.The above problems have a serious impact on the stability of the rural society,leading to the aggravation of the contradictions among the villagers.Therefore,it is urgent to solve such problems.The focus of this paper is on the distribution system of compensation fees given by the government after the land contracted by rural out-married women in their original birthplace is collected.Taking the disputes arising from the specific distribution of this kind of compensation as the starting point and home of the research.Firstly through case analysis,the paper sorted out the status quo of whether rural out-married women can obtain the compensation distribution qualification under such circumstances.Secondly,the paper analyzed the causes of disputes between rural out-married women and the village group in the specific distribution of such compensation.Finally,through the analysis of the existing legislation and local regulations on rural out-married women contracted land expropriation compensation cost allocation policy,This paper put forward feasible suggestions and countermeasures for the problems in the distribution system of compensation fees given by the government after the land contracted by rural out-married women in the original birthplace is collected.Firstly,improve relevant legal review and oversight mechanisms.The legislative review mechanism of village rules and contracts and the relevant legal system for the protection of women’s rights and interests were refined,clarified and improved,so as to provide a clear and unified identification standard for the membership of rural out-married women,so that the protection of the rights and interests of rural out-married women had laws to follow.Second,we will improve the legal system of relevant procedures.Firstly,by expanding the scope of accepting cases,all cases of "rural out-married women" can obtain effective relief through litigation.Secondly,strengthen the design of the supervision system of the village rules and contracts,promote the village rules and contracts reasonable and legal through supervision from all sides,and ensure the effective protection of the rights and interests of rural out-married women in land acquisition,compensation and distribution.
