Study On Supervision Right Of Nanjing National Government

Power and human society complement each other.The problem of power restriction is an eternal topic in human society.As a kind of weighing instrument to restrict power by power and regulate the normal operation of the state mechanism,supervision system plays an important role in the political system.As an important carrier of supervision effectiveness under the supervision system.The supervision right has its own internal logic of development.From its initial emergence in the administrative power to the formation of an independent supervision system separated from the administrative power,its supevision power and supervision operation are becoming standardized and mature.As the product of the development and integration of the traditional supervision mode and the modern supervision mode,the supervision system of Nanjing national government has its own characteristics and research value in the supervision research.Therefore,this paper takes the supervision right of this period as the starting point of research,and studies the supervision right of this period through the methods of literature research,comparative analysis and historical analysis in order to restore the supervision system of this period.The first part of this paper traces the historical background and ideological origin of the supervision right of Nanjing national government,and constructs the internal logic between the supervision right of Nanjing national government and the social background of the era.At that time,under the background of factionalism,party struggle,democratic and free thought prevailing,and social and economic decline,the supervisory power established a new supervisory mode of great significance in modern Chinese society by inheriting and learning from the Chinese traditional supervisory system,the western supervisory system and sun yat-sen’s supervisory thought.The second part of this paper is a constitutional investigation of the supervision power of Nanjing national government under the five-power constitution.The third part introduces the supervision right system design of Nanjing national government.Through the institutionalization process of supervision power in the period of military and political affairs,political training and constitutionalgovernment,the core system of supervision system designs the system of civilian supervision and the system of supervision to understand and grasp the whole system design of supervision power in this period.The fourth part analyzes the supervision power of Nanjing national government.The system itself is a set of abstract and lifeless rules and systems,and the underiving reason for its performance lies in the effective operation of the system.Therefore,this part mainly analyzes the operating mechanism of supervisory power from the aspects of its operating mechanism,operating mode,the operating relationship between supervisory power and party power under the moder of party governance,and the operating effect of supervisory power.From the supervisory personnel management mechanism,the safeguard mechanism of power operation,the supervisory avoidance mechanism and other operating mechanisms,the paper introduces how the supervisory power operates under the supervisory network system in this period.The fifth part evaluates and reflects on the supervision right of Nanjing national government.While affirming the inheritance and reference of the supervision right in this period to the supervision system in China and the West,this paper explores the attempts made and difficulties encountered in its practice,and then makes an objective and fair evaluation of the supervision right in the period of Nanjing national government.History is the rest of present and future,even though the right of supervision of Nanjing national government period on the supervisory efficiency reveal fails to reach its designed,finally the tool of reduced to the kuomintang dictatorship,but it also has a positive and draw lessons from of place,in the current critical period of in-depth reform,the supervisory system in our country in history,for rest,to learn useful experience and lessons will enable us to get new things in the supervisory system construction.
