Research On The "Supervisory Yuan"System In Taiwan

The supervision system is a kind of official system inherited from the long history of our country.The "Supervision Yuan" system in Taiwan area of our country was established on the basis of the theory of "Five Powers Constitution" proposed by Dr.Sun Yat-sen after inheriting the traditional supervision system and inspecting the separation of powers system in western countries.This paper mainly introduces the supervision system in Taiwan,which is marked by the existence of "Supervision Yuan".From initial preparation to the actual establishment,"were" has experienced twists and turns,including several change system,supporting the corresponding law,the constitution of the republic of China until 1946 and all previous change after text,truly complete the "were" the nature of the positioning and functions and powers.In terms of function setting,the "supervision institute" is an independent power preservation organization.Western democratic countries also have similar anticorrosive mechanisms,but the difference is that in most Western countries,the parliament is responsible for this responsibility,while the characteristic of the supervisory system in Taiwan is that the "Supervision Yuan" is an institution independent of the parliament,which is in an equal and independent position with other power departments.In terms of organization,the Supervision Yuan is composed of presidents and vice presidents,the supervisory committee,the meeting and committee of the Supervision Yuan,and the audit department.Its functions and powers are impeachment,rectification,correction and audit.By exercising these supervisory powers,the supervisory role of the "Supervision Yuan" can be brought into play.However,some people put forward the defects of its operation,such as its existence makes the power relationship complicated,the power operation lacks the sanction power and can not effectively exercise the power of impeachment.Through the discussion of the historical origin,nature,status and function of the system of the Yuan of Supervision in Taiwan,this paper expounds the rationality of the existence of the Yuan of Supervision,and makes a comment and analysis on the defects and disputes in its operation,so as to put forward the attitude that the Yuan of Supervision should be retained and its prestige should be regained through reform.At the same time,this paper will also expatiate on the relationship between the "Supervision Yuan" and the "Legislative Yuan","Executive Yuan","Judicial Yuan" and "Examination Yuan",the interaction and cooperation of the power,as well as the characteristics of the power of supervision,the operation mode,the guarantee and restriction mechanism and the practical effect of the operation.
