Research On Comprehensive Administrative Law Enforcement Mode From The Perspective Of Administrative Ecology

The legal system of comprehensive administrative law enforcement reform can be traced back to the"Administrative Punishment Law"of 1996.From the relatively centralized administrative punishment power to the comprehensive administrative law enforcement under the background of the large department system,it has expanded from some pilot cities to comprehensive development.The urban management field extends to the fields of culture,transportation,agriculture,and market supervision.The organizational structure,operational mechanism,and law enforcement effectiveness of comprehensive administrative law enforcement have been optimized.The internal contradictions of law enforcement departments and their contradictions with society and the public have been obtained to some extent alleviate.On the one hand,under the new law enforcement mode,new management and operational contradictions have emerged within the comprehensive law enforcement department,and the contradiction between law enforcement agencies and citizens and society still exists.On the other hand,in the context of comprehensively deepening reforms and a new era,the increase in the demand for citizens and the development of the social economy put forward higher requirements for the reform of the administrative system.Recently,the Party Central Committee decided to form the first comprehensive committee for the rule of law in the history of the whole country,so as to comprehensively strengthen the work of coordinating the rule of law.This shows the urgency of the reform and optimization of comprehensive administrative law enforcement.In the complex administrative environment,the comprehensive administrative law enforcement reform is affected by various factors,and it is difficult to analyze the problem directly.Therefore,the author analyzes the current stage of the comprehensive administrative law enforcement reform from the perspective of administrative ecology and the mode.State characteristics.On the basis of the macro-cognition of the reform model,it focuses on the specific problems and influencing factors under the framework of the model,and then proposes the optimization path of comprehensive law enforcement reform.Through the combing of the comprehensive administrative law enforcement reform model,it is found that scholars classify the comprehensive administrative law enforcement mode mainly based on the origin of reform ideas,comprehensive methods and logic,and organizational structure.However,these classifications are actually a generalization of all the phenomena that appear in the development process of comprehensive administrative law enforcement or the current law enforcement situation,and the classification perspective is relatively microscopic,only biased towards a specific standard,and it is not useful.One way to summarize and define the extent to which current integrated law enforcement reforms have evolved,and the differences between pre-and post-reform goals.Under the guidance of the administrative ecological theory,the author defines it as the prism reform model.Compared with the reform objectives and the reform objectives,the comprehensive administrative law enforcement has obvious heterogeneity,overlap and formalism,which leads to the comprehensive administrative law enforcement reform.There is still a long way to go between the transition period of the old and new law enforcement and the goal of reform.On this basis,the five elements of administrative ecology（economic,social,communication network,symbolic system,political structure）are used as the analysis framework of the problem,according to the combing of relevant theories,the work practice of law enforcement departments,and the speeches of relevant internal leaders.Outstanding problems in the comprehensive administrative law enforcement and sorting them into questionnaires are distributed to the public officials of the comprehensive law enforcement departments with certain work experience and professional ability.Through the analysis of the collected questionnaire data,it is found that the comprehensive administrative law enforcement under this model is affected by a certain The direct effects of these factors are also indirectly affected by certain factors.Among them,the specific factors that have a direct impact on comprehensive law enforcement are:X₂（independence of financial power）,X₄（disparity of treatment）in economic factors,X₁₀（internal liquidity）in social factors,X₁₃（enforcement attitude）,X₁₄（Degree of cooperation between government and society）,X₁₇（enforcement equipment configuration）in communication network factors,X21（professional honor）,X₂₈（policy recognition）in symbolic system factors,X₂₉（enforcement resistance）in political structure factors,X₃₄（Rationality of resource allocation）;Because of the specific factors involved in the questionnaire,in order to facilitate analysis,many factors are integrated into five ecological factors analysis,symbol system can have a significant direct impact on the dependent variable;and economic,social,political structure Not only can it directly affect the dependent variable,but also partially affect the dependent variable through the intermediary variable.Among them,social factors,political structures,symbolic systems,and communication networks that mediate the relationship between economic factors and dependent variables are political structures,symbolic systems,and communication networks that mediate social and dependent variable relationships.The symbolic system,communication network,and social elements are mediating the political structure and the dependent variable relationship.Therefore,according to the analysis of comprehensive administrative law enforcement problems and influencing factors under this model,the indirect impact of the overall ecological factors on comprehensive law enforcement and the impact of specific influencing factors on comprehensive law enforcement are proposed from the strategic level and the action plan level.Optimization path.
