Research On The Legal Issues Of Safety Supervision Of Wechat Business Selling Homemade Food In China

With the development of "Internet +",the phenomenon of engaging in self-made food business activities with the help of social networking platform is becoming more and more common.As a business model to break traditional transactions,the legal relationship of We Chat businesses sales is relatively complex,and consumers’ legitimate rights are vulnerable to infringement.Although China has formed four levels of legal supervision system for network food safety,including laws,administrative regulations,rules and local regulations,because of the virtual,concealed,space-time and other characteristics of " We Chat moments shopping",many social platforms sell self-made food behavior is still in the blind area of existing laws,and the problem of self-made food safety frequently occurs online.It poses a new challenge to self-made food safety supervision of We Chat in China.Based on the analysis of the current situation,characteristics and existing problems of self-made food sold by We Chat in China,combined with the actual situation,this thesis points out the following problems existing in supervision of self-made food safety: poor applicability of laws and regulations,vague provisions of access system,difficult to distinguish between true and false transaction links and lack thereof,dispute settlement system.By comparing and drawing lessons from the United States,South Korea,Japan and the European Union in the supervision of homemade food safety on the Internet,this thesis provides experience and lessons for strengthening the safety supervision of homemade food sold by We Chat in China.On this basis,combined with China’s national conditions,the thesis puts forward targeted policy recommendations on strengthening the supervision of self-made food safety by Wechat: Firstly,to clarify the relevant laws and regulations on self-made food safety supervision by We Chat;Secondly,we should standardize the permission admission system of online food operators for online sales.Thirdly,we should establish the norms of online food transportation in express industry.Fourthly,we should establish an efficient dispute resolution system.
