The Study On The International Law Protection Of Climate Refugees

Climate refugee is a new problem that has emerged in recent years and has attracted more and more attention from the international community.The main reason is that people in some countries have lost their homes and been forced to move outside their countries as a result of climate change.At present,due to the differences in understanding of climate refugees,there are many difficulties in protecting them under international law.So concerning climate refugees protection really has very realistic significance.It can promote the improvement of the system of international refugees,make the basic rights and interests of this group to get a reasonable security,and promote the progress and development of the human rights and the international community.Based on the documents of international conventions related to the refugee issue,this paper starts from the basic issues and combines the methods of literature analysis,text analysis and case analysis to carry out the analysis and discussion.According to the definition of traditional refugees in international refugee law,this paper tries to conclude the definition of climate refugees by combining the causes of climate refugees,the forced nature of migration and the characteristics of crossing national boundaries.It also analyzes the necessity of protecting climate refugees under international law,mainly including the promotion and protection of human rights,guiding mankind to pay attention to the problem of climate deterioration and contributing to the stability and development of the international order.The differences between climate refugees and traditional refugees in their causes and resettlement goals have led many countries to deny their refugee status.As a new global problem,climate refugees should be actively assisted by all countries in the world.However,due to the lack of clear international law basis for the responsibility of the current emitters,the relevant countries shirked their responsibilities,leading to the large-scale displacement of climate refugees and nowhere to live.At the same time,the UNHCR and other international organizations lack the corresponding protection for climate refugees,which are not yet included in their scope of activities.This problem also needs to be addressed.In addition,there are also some deficiencies in the international judicial relief of climate refugees,leading to difficulties for climate refugees in suing other countries for responsibility.Combined with the above problems,this paper believes that the generation of climate refugees should be treated with the times.And the components of climate refugees and traditional refugees are not different except the causes.So the refugee status of climate refugees should be recognized to give them more comprehensive protection.As for the responsibility of emitters,this paper analyzes the responsibility size of each country by constructing a scale model,and then each country accepts climate refugees or provides relief funds according to the responsibility size.For international organizations,this paper advocates the establishment of a special organization for the protection of climate refugees.After all,the existing refugee organizations such as the UNHCR has limited energy in all aspects,and the traditional refugee protection work pressure is already great.So the establishment of a special organization for the protection of climate refugees can assist climate refugees better.Finally,this paper explores the international judicial relief system of climate refugees,and tries to put forward some ideas to help the international judicial relief of climate refugees.
