The Research On Coal Mine Safety Supervisory Law Enforcement On-Site Disposal Measure

Coal Mine Safety Supervision is an important part of the responsibility system of“enterprise responsibility,local supervision and State Supervision” for coal mine safety production,and plays an important role of in supervising,ordering and guiding the administrative counterpart to eliminate hidden dangers in time and prevent and contain coal mine production safety accidents.The accurate identification of the attributes of the administrative behavior of the on-site disposal measures of the coal mine safety supervision is the premise of the implementation of the on-site disposal measures of the law enforcement.The identification of the application of "command" Administrative Act is the basis of ensuring the effectiveness of law enforcement and the legitimate rights of the administrative counterpart.On the basis of the problems such as the unclear attribute of the Administrative Act of the on-the-spot disposal measures of the law enforcement of the coal mine safety supervision,the unclear applicable requirements,etc.,this paper analyzes the structure and applicable conditions of the "command" Administrative Act,to identify the attributes of administrative acts and the applicable circumstances of the on-site disposal measures for law enforcement,and to promote the standardized implementation of administrative orders,administrative penalties and administrative coercive measures in the on-site disposal of law enforcement,advancing the concretization of administrative orders in the field of supervision and law enforcement.The on-site disposal measures of coal mine safety supervision and law enforcement are not scientific in legislative concept,not unified in legal norms,not standardized in applicable carrier,etc.,put forward in the legislative idea,the legislative practice,the law enforcement practice and the internal clear law enforcement spot disposition measure application situation,the optimized document pattern and so on suggestion,promotes the administrative order theory in the legislation and the law enforcement practice approval and the application,standardizing and standardizing the implementation of on-site Disposal Measures for coal mine safety supervision and law enforcement.
