| The coal mine safety is an important issue to the governments of most countries. It is not only related to China's energy producing security, the human being's lives and property, but also related to the construction of the harmonious society as well as the sustainable development of the economy and society. Because of the current grim situation of frequent accidents, and the mine safety challenges, this paper, as a starting point, makes a detailed analysis on the current situation and problems, focuses on the legal issues of ensuring the coal mine safety, and puts forward some advice that how to improve the existing laws and regulations by learning the legislation experience from domestic and abroad. By summarizing the problems of the existing coal mine laws and regulations in China, this paper centers on the relative foreign coal mine laws, especially in the United State and domestic local legislation such as that of Shanxi province,and proposes concrete legal countermeasures and suggestions by taking the amendments of "Law of the People's Republic of China on the Coal Industry", "Law of the People's Republic of China on Safety in Mines", and "Coal Mine Safety Supervision Regulations" as opportunity. |
