Problems Of The Legal Systems Of Safety Production In Coal Mine Of China And Its The Improvement

With the rapid development of economy, the leading position of coal as an energy source is increasingly important in China. Mine disasters occur frequently in the process of coal mining, which caused great casualties and property loss. The situation of coal mine safety in China is not optimistic.In order to change the current situation and to achieve zero mortality rate of safety production, this paper considers that it is necessary to pay close attention to implement and improve the relevant laws and regulations of China’s coal mine safety production. The paper that starts with the establishment and improvement of a legal system of coal mine safety production shows a lot of collections and researches of relevant documentation in this region. Through information and cases analysis, the paper points out the main causes of the frequent occurrence of coal mine accidents in China. According to the research on the legal system of coal mine safety production in the United States, Britain, South Africa and other major energy powers, the paper believes that the improvement of legislative authority, the establishment of efficient and reasonable supervision institutions, the establishment of strict legal responsibility investigation system, the standardization of applying safety production compensation and other advanced concepts which foreign experts propose and initiate have important inspiration and reference value for the establishment and improvement of the legal system of coal mine safety production in China. Therefore, according to the current conditions of the safety production in China, the paper puts forward the strategies and suggestions for the establishment and improvement of the legal system of coal mine safety production in order to absorb and utilize these experiences more effectively. The strategies and suggestions which can finally realize the coal mine safety production include: to establish the concept of people-oriented through defining a clear legislative ideas, to improve the legal system of coal mine safety production and revise the original one, to strengthen the legal system of safety inspection and supervision, to strengthen the management functions of labor union, to communicate a safety culture, to handle safety trainings and other measures.
