Minors involved in crime as a special group that has long been concerned in our country.With the continuous improvement of the criminal justice system of minors in our country,the punishment strike has gradually developed toward the direction of judicial protection.Since the establishment of a conditional non-prosecution system in the Criminal Procedure Law in2012,the special procedures for juvenile criminal cases in China have entered a new stage,aimed at protecting the criminal justice rights and interests of minors involved at the institutional level,and promoting the judiciary ’s handling of minors The legalization of human cases.With the implementation of this system,the procuratorate has been given more responsibilities and missions,while providing professional requirements for prosecutors to handle cases,it also provides an opportunity for social forces to participate.In particular,the investigation and assistance links in this system,due to the diversity of minors involved in crime,it is difficult for a single assistance method to meet their re-socialization needs.Taking social work as the representative of professional social forces,with its advantages in philosophy and methods,In the process of participating in teaching and assistance,the prosecutors promoted the impartiality and professionalism in handling criminal cases involving minors,and formed a new model of cooperation and assistance between the procuratorate and the social forces,with a clear division of labor and complementary advantages.This article takes the research work of criminal minors in the W District Procuratorate of Xi’an as the research object.As a social worker,the author conducts a field survey of the status of the district ’s teaching work,and collects the information through the application of the literature method and the participatory observation method.Research materials are required.Firstly,through the system review,it reviewed the development process of social work participation in teaching and assistance,and discussed the teaching methods in Shanghai and Shenzhen area to gain experience and enlightenment.Secondly,through participatory observation and analysis,there were contradictions in the teaching work of the Procuratorate of the W District and the work of all parties was loose.Insufficient professional level of teaching staff and raised the necessity of social work to participate in the teaching work of the procuratorate of the district.Finally,combined with the practical work of the district,inspired by the experience of teaching in developed areas,it was proposed that the district should establish a multi-party collaborative teaching work mechanism and actively introduce it into the society.Work participation in teaching and assistance,on the basis of establishing the teaching principles,by establishing a professional staff team,perfecting the original working mechanism,under the effective supervision and guidance to give full play to their professional advantages to help them standardize the teaching and teaching practice process,and then form a set of Leading,supported by social work,an integrated educational and educational work mechanism with the participation of multiple social forces. |
