Net labor,the laborers who provide labor for the Internet platform,is the product of the new economic mode of "Internet plus" economy.Its flexible working characteristics are quite different from the traditional employment patterns.And because of its high flexibility with the new economic mode,the world has entered the Internet plus era,and the information transmission speed of the Internet platform has made the enterprises more attractive.The industry supervises external production more efficiently.And because of the Internet plus era of big data,cloud computing and other technologies to accurately grasp the needs of consumers,enabling enterprises to more accurately grasp market demand and respond to market changes is an important guarantee for enterprise competitiveness,which has led many start-ups to specialize in these technologies,and veteran enterprises have gradually shifted their focus to these core technologies,and other business activities are more.So the extension of production link is increasingly obvious.With the continuous change of the form of labor in enterprises,the thinking of workers has also changed dramatically.In our country,with the rapid development of our economy,the quality of people’ s material and spiritual life is constantly improving,along with the continuous improvement of people’ s requirements for material and spiritual life,so the life concept of workers has changed greatly.The increasing demand of laborers for a better life makes them hope to have more flexible working hours to enjoy a better life in the new era with more abundant materials,and the sense of occupational security of traditional subordinate labor is declining.Because of these factors,more workers,especially the new generation of workers represented by the post-90s,are willing to get rid of the shackles of various subordinations in the traditional labor relations and find an independent way of employment.In this context,the rapid development of network platform employment,the scale of network contract workers is growing.The scale of the network contract workers is growing,but the following is the increasingly prominent social security problems.Due to the characteristics of the network contract workers and the particularity of the way of employment,the labor rights and interests of the network contract workers are not fully aware of their own rights,the existing labor security system in China is difficult to effectively protect the labor rights and interests of the network contract workers,and it is difficult to determine the identity of their workers in judicial practice Difficult problem.This paper discusses how to protect the legitimate rights and interests of Internet contractors on the basis of referring to the relevant foreign legal systems and analyzing the existing problems and practical problems in China’ s relevant legal systems.The fundamental solution to this problem lies in clarifying the nature of labor relations between Internet contractors and Internet platforms,and on this basis supporting corresponding policies and laws and regulations,from social insurance,employment services,and determination From the three aspects of relevant labor standards,the labor rights and interests of network contract workers are guaranteed in an all-round and three-dimensional way through three main bodies:platform,labor union and court.
