| Since the beginning of this century,China’s economic development has reached a new level,and the aging of the baby boomers after the founding of the country has accelerated the pace of China’s aging society,with the total working-age population continuing to decline,the proportion of the elderly population rising,and the size of the retired population expanding.With the improvement of life expectancy and quality of life and medical care,more and more retirees are still healthy and capable of working after retirement,and decide to return to work out of the need to get paid or to realize their personal value.Although the proportion of retired workers in the labor market is gradually increasing,their legal protection is lacking,and the state has not yet established special legal regulations for their legal status and protection of their rights and interests.With the re-employment of retirees becoming the norm in the labor market,it is not uncommon for the retired re-employed to have their rights and interests infringed in the labor process.To effectively protect the legitimate rights and interests of the retired reemployed group is an inevitable step to promote the reemployment of retirees,to develop the resources of the elderly and to stimulate the "silver hair dividend".As a new type of employment situation in the labor market,the law in China lacks corresponding regulation and protection for retired people,which leads to the infringement of their rights and interests.At present,the difficulties faced by the retired groups include the lack of qualification of workers,the lack of recognition of labor relations,employment discrimination,the lack of protection of the rights and interests of work injury insurance,and the difficulties in safeguarding the rights of labor disputes.The deeper reason for this dilemma is the traditional concept of hindering the employment of retirees,the imperfect legal mechanism,and the weak awareness of the rights of retirees.Therefore,it is necessary to improve the supply of retired workers’ rights and interests protection system,establish an employment service system for retired workers,establish trade unions to enhance negotiation and relief capabilities as well as raise their rights awareness. |
