Research On The Contract System In Tumet Area During The Period Of The Republic Of China ——Take Mongolian Kim Family Contract Documents As An Example

The Republic of China is the most recent period of history before the founding of the People’s Republic of China in the long river of Chinese history,and its system has a relatively unique nature.During the Republic of China period,as a gathering place for Mongolians,the Tumet region also had unique features in the fields of economy,culture,customs,politics and institutions.During the Republic of China period,as a gathering place for Mongolians,the Tumet region was unique in terms of economy,culture,customs and other fields,as well as in politics and institutions.Since the Western Zhou Dynasty,the contract has been an indispensable transaction certificate in the daily life of the people,and there are also relative differences between different periods and different regions due to social and economic development and different people’s living customs.In ancient and modern China and abroad,many scholars have paid more attention to the contract system,but the research on the contract system in ethnic minority areas is countable.Therefore,the study of the contract system in the Tumet region during the Republic of China period can not only supplement the historical gap of China’s contract system,but also have great significance in making up for the study of the contract system in ethnic minority areas.This paper is mainly based on the newly unearthed Mongolian Kim family contract documents,the study of the civil and commercial contracts in the region,through the discussion of the content of the Tumet region contract system,the main distinguishing characteristics of the Tumet region compared with other regions in the Republic of China period,such as changes in the terminology of contract documents,the prominence of women’s status,the contract proxy system,the Chronology of Genghis Khan and the national characteristics of the parties to the contract.These regional characteristics and their complete development forms also reflect the diversity of traditional Chinese legal culture and distinct national characteristics.It has laid a solid foundation for the development of china’s contract law today,and also provided a solid enlightenment for future progress.
