Investigation,which is an important part in judicial proceedings,is extremely brief in the code of laws.This article is based on Longquan judicial Archives(龙泉司法档案),trying to describe the changes in Investigation rules,procedures and practices from the late Qing Dynasty to the early Republic of China.Through analysis of litigation Archives,it can be seen that during the period of the late Qing Dynasty to the early Republic of China,the practices of Investigation became more and more standardized.And the adjustment of the format and content of the investigation documents has strengthened its supervisory.With the judicial reform and the enhancement of personal legal awareness,the specific practice of investigation paid more and more attention on the validity of evidence.For example,due to geographical and kinship relationships,the reliability of the elderly‘s testimony could be questioned.However,during the period of the late Qing Dynasty to the early Republic of China,the general procedures and practices of Investigation have not changed much.the investigation still retained many of the behavioral habits of the late Qing Dynasty.It shows the continuity from the late Qing Dynasty to the early Republic of China. |
