A Report On Translation Of Elements Of International Law (Sixth Edition)(Excerpts)

From the Reform and opening-up to the implementation of Belt and Road Initiative,the relation between foreign countries and China has been deepened.In the West,countries as America,Britain,France,etc.,prefer to protect their national interests and raise their international influences by applying international law.Compared with the West,China still has a long way to go in utilizing international law to protect national interests and promote the development of international law researches,and the translation of international law.The content of report is based on Henry Wheaton’s Elements of International Law(Sixth Edition).In this period,the translator translates Section 24 of Chapter Three,which includes laws about rights of war as to neutrals.The report specifically describes the background,features and process of the translation report and discusses the functional equivalence in the practice by focusing on case analysis.After feature analysis,the translator realizes that the application of functional equivalence appears in lexical,syntactic and textual levels.Lexical level includes equivalent translation of nominalization structure,idioms and legal terms.Syntactic level includes equivalent translation of passive sentences and complex sentences.And textual level includes equivalent translation by using reference,ellipsis and conjunction.Only a comprehensive consideration of functional equivalence from these aspects,can the logic of legal translation be reasonable and the translation clear.International law translation is a process of high preciseness and clear logic,which bears high demand on the quality of the translation.Hopefully the experience of the translation may be helpful to those working hard on the translation of international law and the development of Chinese international law.
