A Report On The Translation Of Chapter 10 Of Basic Criminal Law

Taking Nida’s functional equivalence as the theoretical foundation,this translation report chose Chapter 10 of Basic Criminal Law of the United States as the source text and discussed the application of functional equivalence theory in the translation of legal texts.Based on the theory of functional equivalence and the author’s translation practice,this report explored the translation methods and translation techniques in translating legal terms and complex sentences in Basic Criminal Law.At lexical level,this translation report mainly discussed the translation of legal terms.The author believed that literal translation and free translation is both acceptable in legal terms translation.When the concepts are equivalent,the translator use literal translation and choose the exact words.When the concepts are totally different,the translator should use free translation and make interpretation in translation.At the syntactic level,the translator adopted appropriate methods to tackle complex sentences,such as linear translation,reversing,division as well as synthesizing to produce on its readers an effect as close as possible to that obtained on the readers of the original text.The translation of human rights provisions in Basic Criminal Law is intended to serve as guidance to the reform of judicial system and help to improve and perfect the human rights protection in China.The exploration of how to translate legal terms and complex sentences in the source text is expected to contribute to theories and practice in translation of legal documents.
