Research On The Protection Mechanism Of Citizen Health Data Under The Background Of Intelligent Medical

The development of information technology such as big data,IOT,AI and cloud computing is constantly changing people’s production and life style.The wide application of these technologies in the field of health care has promoted the emergence of smart medicine.Due to the characteristics of high degree of electronic health care data,easier medical data collection and storage,more integration value of health care data,more participants in the field of health care,more frequent data transmission and interaction,the risk of data leakage increases,which makes the health care data security problems prominent in the context of smart medicine.Firstly,according to the stakeholder theory,this paper defines the stakeholders of health care data protection: health care data subject,controller,processor and regulator.Secondly,by using the method of literature research,this paper combs the current situation of health care data protection in China,and makes a comparative analysis with the health care data protection mechanism in the United States and the personal data protection mechanism in the European Union.It concludes that there are some problems in the health care data protection mechanism in China,such as lagging legislation,lack of systematicness in the current system,unclear rights of citizens to health care data,unclear accountability and punishment mechanism It is not perfect.The public thinks that data controllers,industry associations and government authorities represented by medical institutions are the main responsible entities for health care data protection.The system of legislation,punishment mechanism and data classification management should be improved,and the supervision system of combining government and non-government supervision should be established It is an effective measure to protect citizens’ health and medical data.Finally,according to the deficiency of health care data protection mechanism in China and the needs of the public,this paper puts forward countermeasures from three aspects: improving health care data protection system,improving health care data protection supervision system,and strengthening self-discipline of health care data controllers and processors.The security of health care data is not only related to the individual rights and interests of citizens,but also a part of national strategic security.This paper puts forward suggestions to improve the protection mechanism of health care data from three aspects of system,supervision and industry self-discipline,in order to provide reference for the practice of health care data protection.
