| Since the implementation of the river chief system,it has broken through the original management pattern of water control in Kowloon and helped to solve the difficulties in river basin management.Under the strong recommendation of the local government and the state,the river chief system has gradually evolved into a stable environmental legal system.However,river and lake governance is a systematic and long-term project,and river and lake governance requires the close participation of the public.The report of the 19 th National Congress of the Communist Party of China clearly pointed out that it is necessary to build an environmental governance system led by the government,with enterprises as the main body,and with the participation of social organizations and the public.This means that the public,as the most critical social force,can play a role in the governance of rivers and lakes,and should be paid attention to.Therefore,improving the public participation mechanism is of great significance to ensure that the public participates in river and lake governance in a reasonable and orderly manner.By analyzing the status quo and existing problems of the public participation system under the river chief system,this thesis explores ways to improve the social public participation under the river chief system.change.This article is divided into five parts for discussion:The first part is the introduction,which mainly introduces the basic situation of the public participation mechanism under the background of the implementation of the river chief system,and summarizes and analyzes the research results at home and abroad.The improvement of the public participation mechanism under the river chief system in my country can draw on foreign theoretical research experience..The second part is an overview of the relevant theories,mainly to define the concepts of the river chief system and the public participation,referring to the three basic theories of the citizen’s environmental rights theory,the stakeholder theory,and the public governance theory,to provide a theoretical basis for the study of the public participation mechanism,making it clear that the river chief is an innovative move in the water resources management model,although it has achieved good results in practice,but the connection with the public participation system is insufficient.The third part is about the current situation and predicament of the public participation mechanism under the river chief system.It first analyzes the current situation of legislation,and then sorts out specific problems,focusing on the lack of support for the right of the public to participate in river and lake governance,and specifically involving the environment of citizens The rights are not clear and the subject of environmental administrative public interest litigation is limited;there are also deficiencies in the information disclosure of river and lake management,the legal norms for information disclosure are not perfect,and there is no unified information sharing platform;the public is absent in the operation of the river chief system,mainly It is still lacking in the stages of decision-making,performance appraisal,and accountability;there are insufficient incentives for public participation,and it is difficult to mobilize the enthusiasm of public participation.The fourth part is the foreign experience and reference of public participation in watershed governance.This thesis selects more typical countries,mainly including the successful practice of the Tennessee River Basin in the United States and the Murray-Darling River Basin in Australia,and analyzes and summarizes the experience of public participation in the governance of these watersheds.Watershed environmental information disclosure and other aspects can be used for reference.The fifth part is to put forward suggestions for improving the public participation mechanism under the river chief system.Starting from improving the right support for public participation,legalizing environmental rights to lay the foundation for public participation,improving the environmental administrative public interest litigation system,and clarifying the subject qualifications of citizens and social organizations in environmental administrative public interest litigation;Information disclosure legislation,through the establishment of a unified information sharing network platform,to ensure the integrity and authenticity of environmental information;to enrich participation methods and expand the scope of participation,and to introduce public participation in decision-making,performance appraisal,and accountability stages,so as to realize the public’s role in the river chief Finally,optimize the incentive strategy for public participation,set up a special incentive fund to provide financial guarantee for material incentives,and focus on internal incentives to motivate the public to participate in river and lake governance,so as to improve the enthusiasm of the public. |
