Dianchi Lake,located in the middle of the Yunnan-Guizhou Plateau,is an important river basin conservation lake in the upper reaches of the Yangtze River.Since it was seriously polluted in the 1970 s and 1980 s,the state has invested a lot in the ecology restoration.However,after more than 30 years of effort,the ecological environment of Dianchi Lake has not fundamentally changed.The main reason is that the legal system of river basin ecological environment governance is facing a dilemma.Optimizing the governance mechanism,and improving the governance efficiency of the Dianchi Lake Basin are major issues and challenges facing us.Through the sorting and analysis of the literature on the governance system,it is found that the current research on the construction of the local legal system based on the protection of the overall ecological system is not enough.In this regard,the principle of sub-basin governance theory is used to conduct in-depth research on the ecological environment governance of Dianchi Lake,and according to the viewpoints of governance institution theory,the shortcomings of the current ecological environment governance mechanism are necessary.Including: focusing on point source project governance,linear thinking governance,focusing on emission behavior regulation,and so on.It is manifested as imperfect legal system and unsatisfactory governance effect in Dianchi Lake Basin.In order to break the institutional predicament,it is necessary to optimize the governance mechanism under the requirements of sub-basin governance.Combined with the governance of the Dianchi Lake and reference to domestic and foreign governance experience,in accordance with the principles of integrity,differentiation and comprehensiveness,further improve the Dianchi Lake ecological environment legal system.Aiming at the problems in the current governance and the operation of the ecological environment legal system,it is first necessary to optimize the administrative licensing,administrative supervision and related supporting legal systems.For example in particular,environmental impact and ecological quality evaluation,construction projects "three simultaneous",emission permit,total control,emission rights trading,environmental monitoring,ecological environment credit,environmental liability insurance,agency enforcement,and ecological damage compensation.These institutional optimizations need to be achieved through strengthening local legislation and institutional reforms.The conclusions of this study is a local legislative suggestions for protection of Dianchi Lake Basin. |
