| With the rapid development of industrialization and urbanization,soil pollution has become an environmental problem that cannot be ignored,and the remediation and treatment of contaminated soil is a realistic and urgent requirement.Although legislation on soil pollution prevention and control has been developed in China in recent years,soil remediation practice has also achieved some results,but this does not mean that soil pollution has been fundamentally solved.The implementation of legal responsibility for soil pollution remediation is of great significance for effectively restoring soil ecological environment functions and maintaining public health and safety.This article is divided into four parts.The first part discusses the theoretical content of the legal responsibility for soil pollution remediation,defines the relevant concepts and properties of the legal responsibility for soil pollution remediation,and analyzes the related theoretical basis.The second part sorts out the legislative and practical status of the legal responsibility for soil pollution remediation,and points out the difficulties faced by the legal responsibility for soil pollution remediation in China in terms of responsibility subjects,responsibility distribution,and soil remediation standards.The third part investigates the legislative and practical experiences of the United States,Britain,Germany and Japan in related fields,and extracts useful experiences suitable for our country.The fourth part puts forward suggestions on improving the responsibility for soil pollution remediation,adheres to the concept of "landscapes,forests,fields,lakes and grass" as the restoration guide,improves the main body of legal responsibility for soil pollution remediation,improves the distribution mechanism of legal responsibility for soil pollution remediation,and strengthens the performance of the main body of soil pollution remediation responsibility.responsibility,and reshape the soil pollution remediation standard system. |
