Study On The Accountablity System's Soil Pollution Remediation

The soil pollution prevention and control law issued in 2018 listed soil pollution remediation as one of the important links.Based on soil pollution repair responsibility,first of all define the nature of public law responsibility,then expounds the characteristics of the soil pollution repair responsibility,the responsibility system for the analysis of soil pollution repair perfect theoretical basis,show the development of the soil pollution repair responsibility system,and combined with the United States,Japan,the Netherlands and other countries of soil pollution repair responsibility system experience,analyzes the deficiency of the soil pollution repair responsibility system in China and the reality of the system is running.From the aspects of responsibility subject,responsibility scope,responsibility mode,administrative supervision,judicial guarantee and multiple relief mechanism,some Suggestions are put forward to improve the liability system of soil pollution remediation in China.It is advocated to further clarify the subject of liability and the compensation mechanism,clarify the scope of liability and the repair standard,promote the transformation of the dominant liability form,timely revise the provisions on the subject of liability reduction and exemption,pay attention to the leniency and strictness of administrative supervision,enhance the strength of judicial protection,and build a diversified liability relief mechanism.In order to promote the improvement of soil pollution remediation responsibility system in China to provide thinking space,but also to accelerate the construction of ecological civilization,to effectively maintain the national ecological security to provide support.
