Study On Compensation System Of Ecological Environment Damage

The compensation for ecological environment damage is the corresponding consideration paid by the environmental tortfeasor for his own environmental damage.The definition of the nature of compensatory compensation for eco-environmental damage damages limits the compensation to a limited scope of damage and effectively curbs the trend of expanding the scope.The construction of compensation system for ecological environment damage is to recognize the value of ecological services provided by environmental resources,and realize the value of protecting citizens’ environmental rights,reflecting ecological justice,safeguarding environmental interests and bearing responsibility for profits and losses.China is paying more and more attention to environmental protection and environmental restoration.In recent years,the state and local governments have issued a lot of policies and regulations on compensation for ecological environment damage.If it is the environmental destroyers who have brought great damage to the ecological environment,the amount of compensation is also huge.Due to various reasons,some compensation has not been fully invested in the treatment and restoration of the damaged ecological environment.Through the analysis of the current situation of practice,the following four reasons are summarized: first,the qualification of the main body of ecological environmental damage assessment is not complete,the evaluation method and calculation standard are not clear,which leads to the difficulty in determining the amount of compensation;second,the compensation for ecological environmental damage is handed over to the State Treasury for management,that is,the mode of public power as the leading,lacking of effective supervision,and setting up a special account for compensation Third,the use of compensation for ecological and environmental damage is not clear and cumbersome;fourth,the external supervision of the compensation for ecological and environmental damage is seriously insufficient,there is no complete information disclosure mechanism,and the public’s supervision right is not guaranteed.Based on the above analysis,to improve the eco-environmental damage compensation system,first of all,we must improve the appraisal and evaluation mechanism of eco-environmental damage to ensure the preciseness and accuracy of the amount of compensation;secondly,in terms of the management of compensation,it is feasible to establish a provincial-level eco-environmental damage compensation fund based on the beneficial experience of foreign and domestic mine rehabilitation funds 3、 In terms of the use of compensation,based on the scope of use,different users should be adopted for different types of expenses,at the same time,the use procedures should be standardized,the approval process should be simplified,and the time limit for allocation should be clarified.Finally,the supervision system of ecological damage compensation should be established,and the external supervision should be paid attention to while improving the internal supervision,and the third-party supervision institutions should be introduced to play a greater role.
