On The New Development Of Environmental Legal Responsibility System In China

China’s traditional environmental legal liability mainly depends on three major sectoral laws,including environmental civil liability,environmental administrative liability and environmental criminal liability.The number of legal liability in traditional sector law is large,but the specific application in the field of environmental law is not many.With the continuous improvement of environmental legal norms,many new ways of environmental responsibility have emerged in legislation and practice.These new responsibility-bearing methods still belong to the traditional environmental legal responsibility system in the legislation,so the nature of the new responsibility-bearing mode is unknown.In addition to the problems caused by the different ways of assuming new and old responsibilities,the traditional environmental legal liability also has the problems of high repetition rate of the content of responsibility,confusion in the use of the way of assuming responsibility,and the traditional legal liability can not meet the new needs of environmental cases.In order to solve the problems of traditional responsibility and new responsibility in legislation and practice,on the basis of combing the current environmental legal norms,combines the requirements of the development of environmental rule of law in the new era.Put forward the countermeasures to the development of environmental legal responsibility.Building a systematic environmental legal responsibility can eliminate part of the problems in the legislation,and make it more reasonable and perfect in the setting of the structure and content.In order to solve the purpose of environmental problems,environmental legal responsibility method in environmental prevention,environmental restoration,environmental punishment and environmental education,including the traditional responsibility methods such as stop infringement,fine,and including new responsibility methods such as ecological environment restoration,and theoretical innovation such as enterprise environmental credit evaluation,environmental education and other content.In addition to promoting the concept and development of systematic and typed environmental legal responsibility,we put forward suggestions to improve the development of the current environmental legal responsibility for the perspective of legal function,hoping to improve the deficiencies of the current responsibility system from three punitive,compensatory and preventive aspects.
