Research On The Environmental Legal Liability Of Ecological Restoration

After The fourth plenary session of the eighteenth,our country will promote the construction of ecological civilization in the aspect of the rule of law comprehensively.Ecological environment is increasingly becoming the focus of attention of the people.How to protect the natural ecology more effectively when we develop our economy in the high speed at the same time has become an urgent problem to be solved.In this paper, the study of ecological restorative legal liability inject the rule of power for constructing the new pattern of modern of the harmonious development of man and nature. The concept and connotation of environmental legal liability of ecological restoration is not familiar to most people.The practice of this new liability originated from the part of the grass-roots courts in Fujian Province in recent two years. They order the people who cause or may cause environmental pollution and destruction to plant trees, restore vegetation, purify water quality, graze animals when these people should bear the traditional civil legal liability or Administrative law liability or criminal legal liability,to restore the ecological functions of environment and For the corresponding to reduce or exempt their liability.The paper describes and introduces the theories related to the environmental legal liability of ecological restoration,and proposes it has the characteristics of ecosystem,restoration, comprehensive and diversity,and compare the environmental legal liability form of our country with the foreign, then discusses the rationality and the necessity of the environment legal liability of ecological restoration at a macro level.Finally,this paper puts forward the principle, applicable conditions and main form of the new liability. The author hopes that this research will promote our country attaching great importance to and speed up the recovery of the ecological environment of the relevant legislation and system construction,to make the current environmental legal liability system more perfect and realize the relief of environmental rights and interests,then helps to prevent further damage occurs.
