In recent years,in the face of the problems of high pollution and high energy consumption derived from traditional buildings,green buildings are favored because of their green,environmental and sustainable advantages.In order to comply with the development trend of architecture and implement the concepts of "green development" and "sustainable development",China has formulated laws and regulations from different levels and promulgated many plans and policies to promote green buildings.In order to ensure its high-volume and high-volume development,it also uses diversified means to supervise and encourage it.With the deepening of the promotion of green building,the relevant normative documents gradually expose its inherent defects,and the driving force for the large-scale development of green building is insufficient.The root cause lies in the immaturity and lack of systematization of the legal system of green building.After analysis,China’s green building legal system mainly has the following problems:first,in terms of legal effect,so far,our country does not have a special green building laws and regulations,low legal effectiveness leads to its lack of mandatory and binding force.Second,in terms of the enforceability of the system,there are many provisions on encouragement,advocacy and selectivity in the existing system,which can not provide definite guidance for specific practice.Third,in the applicability of green building evaluation standards,the lack of universality of national standards widens the development gap between regions.Fourth,the supervision system is in a fragmented form,which leads to the lack of dynamic supervision in the whole life cycle of green buildings because of the complexity of administrative structure and the lack of full consideration of the essential attributes of green buildings.Fifth,the incentive object is one-sided,and the imbalance between the incentive subject and the object makes it difficult to further expand the green building market.In order to change the current development dilemma,first of all,it is necessary to improve the legal system of green building,design the top legal system,and formulate a leading and effective special normative document.On this basis,improve the applicability of the legal system of green building,and provide deterministic guidance for its practice.In addition,unify green building standards,narrow regional differences,improve the dynamic regulatory system,and change the promotion model,let the "invisiblehand" dominate the green building market.Under the reform of "releasing management and serving",the government gives priority to macro-control,reshapes the incentive mechanism of green building,uses a variety of incentive policies to cooperate with many main bodies to participate together,forms a complete green building industry chain,and expands the scale of the green building market.promote the realization of scale. |
