| Economic development has generated a large number of wastes,undermining rural ecological balance,and with the advancement of agricultural-to-urban construction,a large number of urban pollutants have been transferred to the countryside,causing rural solid waste pollution to worsen and reducing the quality of rural human settlements.The law as an effective way of social governance is conducive to the treatment of rural solid waste pollution,protects the rural ecological environment,and realizes rural revitalization.Although the state has paid attention to rural environmental pollution in the past two years,environmental protection-related laws and regulations still focus on cities.The laws and regulations concerning rural solid waste pollution have deficiencies in legislation,law enforcement,and justice,which need to be further improved.This article takes Xi Jinping’s ecological civilization as a guide,expounds the concept,classification and pollution status of rural solid waste,analyzes the imperfect laws and regulations,the farmers’ environmental awareness is weak,and the pollution caused by insufficient infrastructure.Recognize that implementing pollution prevention can protect farmers’ environmental rights and promote rural revitalization.On this basis,the current status of the legal system at the three levels of legislation,law enforcement,and justice in the prevention and control of rural solid waste pollution is sorted out,and the inadequacies are further expanded: there are problems such as lagging thinking in the legislation,weak current legal system and lack of legislation.In law enforcement,affected by the problems of the administrative management system,the quality of law enforcement work is not high and the village committees’ autonomous functions are not fully performed,resulting in lax environmental law enforcement.Judicially,there are many dilemmas for environmental protection of farmers and the incomplete compensation system for environmental tort damages affects the fairness of environmental justice.In response to the above issues,the United States,Germany,Japan,and South Korea’s legal experience in rural solid waste prevention and control will be used to reduce the amount of waste at the source,improve the legal system,and encourage public participation in the prevention and control of environmental pollution in combination with rural waste prevention and control.Based on the shortcomings of legislation,law enforcement and judicature,this paper puts forward some Suggestions on how to improve the legal regulation of rural solid waste pollution.First,at the legislative level,establish a scientific legislative concept and improve the system and specific content of the legal system for rural solid waste pollution.Second,at the level of law enforcement,improve the law enforcement management system,improve the quality of law enforcement supervision and give full play to the role of village committee autonomy.Finally,at the judicial level,the peasants’ rights protection is broken by strengthening the peasants’ rights protection awareness and improving the environmental damage compensation system to protect the farmers’ legitimate rights and interests to the greatest extent.By improving the laws and regulations on rural solid waste pollution,we will advance the project to prevent and control rural solid pollution,protect the rural ecological environment,and realize rural rejuvenation. |
