Marine dumping refers to the disposal of wastes and other substances to the sea by using ships,aircrafts,platforms and other means of transportation.It is a way of disposing wastes in many countries,including China.In the 1980s,China successively promulgated and implemented the marine environment protection law of the people’s Republic of China and the regulations of the people’s Republic of China on the administration of marine dumping and its corresponding management measures.However,with the rapid development of China’s marine economy in recent decades,the relevant marine dumping laws and regulations have not been revised for many years,and some provisions have not been able to adapt to the existing management needs and the current marine dumping management in China.Based on the analysis of the current situation of the legislation of China’s marine dumping management system and the data of China’s marine environmental quality and the distribution of dumping areas,it is concluded that there are some problems in China’s marine dumping management,such as the imperfect classification management standards of wastes,the unreasonable selection and planning system of dumping areas,the backward collection and management standards of dumping fees,the imperfect supervision means of dumping operations and the illegal places The legislative issues such as less punishment.In view of these problems,through the international conventions and advanced legislative experience of foreign countries,combined with China’s national conditions,the following suggestions are put forward:first,in terms of waste management norms,it is necessary to issue a list of marine dumping wastes as soon as possible,improve the classification standards and evaluation procedures of marine dumping wastes,and increase the pre review procedures of dumping necessity;second,in terms of dumping In terms of the system of dumping area selection and planning,it is necessary to improve the consistency of marine functional zoning and dumping area selection and planning,improve the criteria of dumping area selection and planning,determine the legislative principle of giving priority to the establishment of offshore dumping area,and actively carry out administrative publicity;thirdly,in terms of the collection and management of dumping fee,it is proposed to include dumping fee into the environmental protection tax system;finally,it is proposed to improve the management and technology of marine dumping recorder Technical standards,and strengthen the punishment of illegal dumping.
