Legal Countermeasures Of Rural Water Pollution And Prevention Research

Rural water pollution problem is serious and complex which has been not only endanger farmers’ health and life,also affect the sustainable development of agriculture,thereby deepening national grain safety risk and food safety risk,the hidden trouble of rural water pollution problem need to be solved.Moreover under the background of our legal system is in construction and steady development,to optimize and enhance the legal system of the rural water environment management is the need of the survival and development,and steadily push forward our country judge management system,indicating water pollution governance significance.Therefore during further research,we need to complete the lack of law on the prevention and control of rural water environment improvement,to ensure the safety of the rural water environment.This article first introduced our countryside water pollution present situation,through this situation explained by the legal system to explore the necessity of water pollution difficult prevention.This paper expounds the harm caused by rural water pollution from three aspects: water pollution harms human health,leads to new social contradictions and is not conducive to sustainable development of economy and society.And the rural water environment pollution reasons are analyzed,that is,the special conditions of the rural market regulation,failure of current laws and regulations limitations,The urban and rural dual environment management system emphasizes four sides of predicament of rural water pollution prevention.Secondly,analyzing the current situation of China’s rural water environment legislation,based on China’s basic law of " Water Pollution Control Act".This paper analyzes the constitution of " Water Pollution Control Act" and the legal system related to the prevention and govern of water pollution in rural areas.Through the development of the legal system,the rural water pollution prevention and control level of the legal analysis,pointing out the current face of legislation,law enforcement and judicial aspects of specific legal issues.Then,from the point of view of law-abiding,this paper illustrates the insufficiency of public participation in the prevention and control of rural water pollution.Thirdly,by analyzing and comparing the research methods,this paper introduces the practice of water pollution prevention and control laws in the United States,Japan,Switzerland and the Netherlands and their enlightenment to China.First,the concept of sustainable development as the guiding ideology;Second,a complete system of laws and regulations;Third,efficient management mechanism;Fourth,active public participation.By comparing and contrasting their own water pollution situation,the author points out the successful experience of these four countries in the water pollution prevention and control work,and extracts some meaningful suggestions for China’s rural water pollution prevention and control work.At last,the paper puts forward the decision of rural water pollution prevention and control from four aspects of legislation,law enforcement and judicial compliance.First,we should improve the legislative system,transform it from the perspective of sustainable development of the legislative guiding ideology,and gradually improve the legal system from three aspects,namely,the principle of fairness,the principle of environmental protection and the principle of sustainable development,and the principle of classified governance.Then through the establishment of rural drinking water sources to protect the rural water environment supervision and management of rural sewage charges collection and use of agricultural production pollution control four systems to improve the rural water environment prevention and control legal system.Second,strengthen the law enforcement level and judicial level of rural water pollution prevention and control in China.Through the improvement of relevant legal system,the establishment and construction of law enforcement agencies to protect the rural ecological environment and improve the comprehensive quality of law enforcement personnel and strict supervision of the judicial process of inaction,slow action disorder acts,so as to strictly enforce the law and justice.Third,through legal publicity and incentives,improve the water environment information disclosure system and improve the democratic participation system of farmers,to enhance the enthusiasm of farmers to participate in the prevention and control of rural water pollution.We will accelerate the establishment of the three red lines for ensuring the bottom line of ecological protection,environmental quality and safety,and the utilization of natural resources.Through improving a series of water pollution prevention and control legal system and implementing various provisions,China’s ecological environmental protection laws and regulations can really be effective.
