Study On The Legal System Of Packaging Waste Utilization

This paper systematically introduces the driving factors of packaging waste resource utilization in three aspects: government,enterprise and public,and the theoretical basis of philosophy,economics and law.After expounding the present situation of packaging waste resource utilization and its legal system,it is found that there are some obvious problems in the legal system of packaging waste resource utilization in our country,such as scattered legal provisions,lack of special law,imperfect supporting system,lack of government responsibility legal system,lack of legal system of technology development,and so on.Then,by using the experience of Germany,the United States,Japan and Taiwan for reference,this paper analyzes and perfects the packaging waste resources in China.After changing the realistic basis of the legal system,this paper puts forward some suggestions on the formulation of the regulations on the Utilization of Packaging waste Resources.From the establishment of the basic principles of regulations,the obligations of relevant parties,the establishment of a standard system,clear supervision and management system and so on.On this basis,this paper puts forward five supporting systems,such as establishing packaging tax system,refining garbage charge system,establishing deposit return system,defining financial investment and subsidy system,perfecting government green procurement system and so on.In order to maximize the legal construction of packaging waste resource utilization,from point to surface,in order to achieve the purpose of continuous development and improvement of circular economy legal system.
