The old district is formed gradually in the course of the long-term historical development and evolution of the city.There are such problems as disordered layout,dilapidated houses,crowded living,traffic jam,environmental pollution,shortage of municipal and public facilities,etc.,old Urban areas that can not meet the needs of urban economy,social development,reform and opening up.Cities,the product of economic development,make people’s life more and more convenient.With the continuous development of our society,the living standards of the people’s living conditions have been gradually raised.The old districts in some cities not only occupy a large amount of land resources,but also have functions that can not keep pace with the pace of the times,far from meeting people’s needs,cities are facing more and more prominent problems of renewal and transformation,especially for various problems such as demolition compensation,which often accompany the process of rebuilding old urban areas,to the urban old area of the demolition work has brought a certain impact.In order to regulate the expropriation and compensation of houses on state-owned land,safeguard public interests and protect the legitimate rights and interests of the owners of the houses expropriated,the State Council has formulated the regulations on expropriation and compensation of houses on state-owned land.Through the study and analysis of the compensation for the demolition of the old district in Huangpu District of Shanghai,it is found that the compensation for the demolition has become an inevitable problem in the process of urban construction,the so-called demolition compensation refers to the demolition of the people in the demolition of the houses provided by the compensation.In China,the compensation forms mainly include monetary compensation and property right replacement,and property right replacement is divided into relocation and resettlement.However,in the process of demolition,it involves the vital interests of the public and also concerns the well-being of a family.If the parties’ reasonable demands are not satisfied or their due interests are infringed upon during the demolition,it will lead to the conflict betweenthe parties,serious words may cause a series of social problems,therefore,it is necessary to remove the compensation process for the removal of risk analysis and assessment,to find ways to eliminate the risk.On this basis,it is of great practical significance to study the compensation for the demolition of the old district in Shanghai Huangpu District.Therefore,this paper takes Huangpu District as an example to study the problems and countermeasures of the compensation for the demolition of the old district in Huangpu District.First of all,the significance and background of the topic,the relevant laws and regulations at home and abroad and demolition compensation model analysis;and then,taking Huangpu District,Shanghai as an example,according to the problems in the compensation for the demolition of the old districts in Huangpu District of Shanghai and the specific reasons for these problems,starting with the course of the renovation and development of the old districts in Huangpu District and the legal basis for the compensation for the demolition and relocation,this paper analyzes the calculation method and relevant case analysis of the compensation for demolition in Huangpu District,Shanghai,and probes into the typical cases encountered in the compensation for demolition,in order to find out the root causes of the cases and solve the measures,thus provides the important theory basis for the Shanghai Huangpu District Old Area Demolition compensation question and the countermeasure research.Finally,from the results of the regional study of Huangpu District,Shanghai,it extends to the whole country and provides a model solution for the compensation for the demolition of old urban areas nationwide,it provides the theoretical basis for solving the compensation problem of old area demolition in the process of national urbanization development.
