After the Third Plenary Session of the 17 th Central Committee of CPC, Chinese central government issued “The Decisions on Major Problems of Impelling Development of Rural Areas†in 2008.The document clarified that commonweal land requisition and commercial land requisition must be defined strictly,in line with reducing requisition scale and improving compensatory mechanism. Collective land should be levied according to laws and regulations, meanwhile reasonable, immediate and adequate compensations should be given to farmers and rural collective organizations in the spirit of “the same land the same priceâ€. And farmers’ employment, relocation and inhabitation should be settled. In 2009 Chinese government launched the amendment work of The Law of Land Administration of the People’s Republic of China. In 2011 the Ministry of Land and Resources approved part of regions to make trial reform on land expropriation polices.Hence the reform and adjustment of collective land expropriation policies and their compensation polices begin to be put into real practice. Meanwhile academic circle also explores deep studies on reform of collective land expropriation, protection of farmers’ interest and land revenue etc. However the focuses of both the reforms and trials promoting by government or academic researches are basically based on the approval mechanism of land requisition, the standards of compensation and its fund origin. Therefore this paper attempts to put forward a new approach on requisition and demolition, which is entitled “Demolition Under People’s Willâ€. Innovations and creations have been implemented under the guideline of this approach. And this approach is based on the present regulations and related policies in Jin Niu District and successful experience from the demolition work in Cao Jia Lane. By mobilizing people’s initiatives, the demolition work is carried out under people’s will and operated integrally. This method on one side avoids conflict between people and government, on another side; it accelerates demolition progress and improves the efficiency of fund utilization. |
