As a result of new technological innovations and the advancement of the industrial revolution,the new employment form of have emerged and become an important source of employment growth.The new employment form derived from the new economy is an atypical employment or flexible employment model that differs from the traditional standard employment model in organization,employment concept,employment field,and technical approach.After 2015,the new employment form has entered a rapid development stage in China,and the number of workers has increased rapidly.The new employment form is different from the previous employment form,which makes the identification of labor relations more complicated,and it is difficult to identify the subject in labor relationship.Therefore,there are many controversies in the participation of social insurance,which bring many problems and challenges to the protection of labor rights and interests of workers in the new form of employment.This article uses quantitative analysis method,based on CLDS database for statistical data research.By constructing a regression model with labor relations and occupational characteristics as the core explanatory variables,an empirical research analysis is conducted,and the following conclusions are drawn:First of all,there are many "missed insurance" or "misplaced insurance" among the workers of new employment form;Secondly,labor relation and occupational characteristics are the main reasons affecting the choice of basic pension insurance for employees in the new employment form;Thirdly,the traditional labor contract as the foundation of the basic pension insurance system has an obvious crowding out effect on the workers of new employment form to participate in the basic pension insurance;Finally,flexible and changing occupational characteristics aggravate the “missing insurance” or “misplaced insurance” of workers in the new employment form.Based on the empirical conclusion,this paper discusses the inadaptability of China's basic pension insurance system to the new employment form from four perspectives: 1.The requirements of the basic pension insurance of employees for formal labor relations are not compatible with the new employment form.This insurance regulation will "closed the door" to most of workers in the new employment forms,and fundamentally cause the policy loss of the workers in the new employment form;2.The payment rate of the employee's basic pension insurance is not compatible with the income status of workers in the new employment form.The heavy burden caused by the payment rate of up to 20% and the crowding-out effect are the main factors that cause them to miss or misplace the insurance;3.The level of protection of the residents' social pension insurance is not compatible with the old-age economic risk faced by workers in new employment form.Most new-employment workers participate in social endowment insurance for urban and rural residents with relatively low levels of protection,and it is difficult to withstand future high-level old-age security needs;4.The lack of fairness in the design of the basic pension insurance system is incompatible with the new employment form.From the perspective of social equity,the design of the current basic pension insurance system seldom considers the labor relationship characteristics of the new employment form,and lacks the dynamic adaptability to the workers of the new employment form,and it is difficult to achieve effective protection for the new-employment-form works.In order to find an effective way to solve the problem of pension insurance for workers in the new employment form,this paper introduces the practice of setting up the third type of workers in some developed countries and the role of labor union organizations in the pension insurance system,from which we can get useful enlightenment.Combined with the actual situation of our country,this paper puts forward countermeasures and suggestions to improve the pension insurance system of our country: 1.we should enhance the fairness of the design of the basic pension insurance system;2.we should adjust the adaptability of the social insurance system to the changes of employment mode in time;3.we should break the dependence of the employee's basic pension insurance participation conditions on traditional labor relations;4.we should set up a multi combination of participation and classified payment mechanism;5.we should improve the overall planning level of basic pension insurance and improve the transfer and succession mechanism of pension insurance benefits;6.we should explore the new development path of the second and third pillar supplementary pension insurance.
