China’s current laws restrict the free transfer of collective construction land,which is not conducive to the optimal allocation and rational use of urban and rural land resources,but also damages the land property rights of farmers.In order to reverse the"separation" of urban and rural land system,activate rural land resources,solve the contradiction between the limitation of land supply and the current expansion of land demand under the traditional land management system,and effectively improve the property income of farmers,the Party Central Committee has made clear instructions as early as the decision of the Third Plenary Session of the 17th Central Committee,requiring "gradually establish a unified urban and rural construction use Land market"makes the transfer of collective land use rights market-oriented and standardized.In the decision of the Third Plenary Session of the 18th CPC Central Committee,it is more directly emphasized to unify the urban and rural construction land market,"establish a land value-added income distribution mechanism that takes into account the state,collective and individual,and reasonably improve individual income".The reform of collective operating construction land entering the market is a systematic project,which not only needs to be guaranteed by legislation,but also needs to be supported by the improvement of relevant supporting systems.Among them,the issue of income distribution in the market is the core focus of the reform process,which is related to the overall situation and the effectiveness of the reform.However,how to construct the income distribution system of collective construction land market is still in the exploration stage in both theory and practice.How to make a good overall plan in the whole country in order to make it standardized,institutionalized and legalized is still an urgent problem to be solved in the reform practiceThis paper consists of six chapters.The first chapter is the introduction part.In this chapter,the research background,research purpose,research methods and research significance of this paper are elaborated in detail,and the existing related literature research is summarized,and the current research status of collective land income distribution is clarified.At the same time,the innovation and shortcomings of this paper are pointed out.The second chapter deals with the definition of relevant concepts and terms in the income distribution of the transfer of the right to use collective construction land,how to use collective construction land,what is the right to use collective construction land and its transfer,and the logical relationship between the collective construction land and the collective operational construction land,"transfer" and"market entry" and "transfer".The third chapter is the interpretation of the theory of land property rights,Marxist land rent theory and other theoretical basis to guide the income distribution of collective construction land or support its system construction.The fourth chapter is the analysis,induction and summary of the policy text provisions of 33 pilot areas determined by the State Council,and on this basis,it puts forward some enlightenment on how to build the income distribution system.The fifth chapter analyzes the specific practice of three typical pilot areas,Wujin District of Changzhou,Jiangsu,Dazu District of Chongqing and Yucheng City of Shandong.It not only points out the achievements in the reform,but also points out the problems in the reform.The sixth chapter is on the basis of the fourth chapter(policy text analysis)and the fifth chapter(empirical analysis),put forward the idea of establishing the income distribution system of the transfer of the right to use collective construction land.Specifically,the construction of the income distribution system of the transfer of the right to use collective construction land can be divided into two levels:one is the external income distribution relationship,that is,between the government and the collective;the other is the internal income distribution relationship,which involves the distribution between the collective and the collective members and the collective members.In the aspect of external distribution,firstly,it defines the theoretical basis of the government’s participation in income distribution,and points out that tax is the most appropriate way of participation;secondly,it puts forward the reform guidance of gradual transition from regulatory fund to tax;finally,it puts forward the corresponding ideas for the design of collective land tax system.In the internal distribution level,it mainly involves the construction of the protection mechanism of farmers’ rights and interests,such as clarifying property rights,unifying the criteria of membership recognition,improving the democratic decision-making mechanism and the corresponding regulatory mechanism.
