Research On The Problem Of Rural Land Circulation In Beihu District Based On “Three Right Division”

Rural areas are the homes of farmers,and agriculture is the support of farmers' survival.The development of agriculture,rural areas and farmers has always been the topic concerned by the Party Central Committee.To achieve rural revitalization,the key is to solve the problem of the country land.From 2004 to 2018,the government has promulgated 15 documents NO.1 continuously,which focuses on solving the three-rural issues,mediating the structure of agriculture,improving the living standards of farmers,improving the rural environment and narrowing the gap between urban and rural areas.As the core element of the "three-rural issues",land plays an important part in farmers,and all the agricultural-related problems in the countryside are also around the land.The land transfer is the key to the scale production of the land,which is one of the contributing factors to improve the efficiency of agricultural production,and also the fundamental step to promote rural development.Therefore,in order to actualize the Rural Revitalization in an all-round way,we need to grasp the core elements of the land and subdivide the right of the land,and grasp the implementation of the land transfer method.After the land reform,the "two rights pattern" of collective ownership and household contract management right appeared in the family joint production responsibility system,while the further land reform the "three rights pattern" of ownership,contracting right and management right.The continuous refinement of land ownership is beneficial to the improvement of the basic land management system,the protection of the rights and interests of the new management subjects and farmers,and the development of agricultural modernization.Therefore,the study of the "three rights division" pattern of rural land circulation is of great significance to improve the rural real right certification and to implement a good and fast land transfer.This article bases on the impact of the property rights structure of “three right division” on rural land circulation.First of all,based on the dynamic research related to land circulation at home and abroad,the current situation of land transfer,property ownership,influencing factors,related models and countermeasures are analyzed,and the development of rural land circulation is grasped from the macro level.According to the existing basic concepts and theoretical analysis,we will further enrich the theoretical framework relying on the existing land transfer experience.The second is the main content of the article.This article takes the rural land circulation in Beihu district,Chenzhou city as a case,and takes the perspective of "three rights division" as the breakthrough point,then sets up the main body of this article through the three rights of ownership,the right to contract and the right to operate.The main contents are: the economic,agricultural and land circulation status of Beihu District,including the property right practice of land transfer,the influence of the e-commerce platform on the land circulation and the basic characteristics of land circulation,and the series of problems caused.And then,further analysis is made on the rural land transfer cases in Lutang,Beihu District,including the introduction of the basic situation of land circulation,the logical analysis based on renting and entering the stock form,and the performance analysis of output value,income and comprehensive effect and the inspiration from it.Finally,on the basis of the development practice of the rural land circulation in the Beihu Distric,the related circulation experience and the comprehensive problems arising from the land transfer,the corresponding countermeasures are put forward from the aspects of land property rights,the subject of circulation,property right financing,exit mechanism and the mechanism of talent development.
